April 13, 1999 <br /> <br /> (b) The facility shall comply with the submitted site plan, floor plan, and <br />building elevation identified respectively as Exhibits A, B, and C, attached hereto and <br />made a part hereof. <br /> <br /> (c) Indoor operations shall be limited to the hours between 6:00 A.M. <br />and 6:00 P.M., Monday through Friday. Outdoor play hours shall be limited to the hours <br />between 10:00 A.M. and 6:00 P.M. <br /> <br /> (d) No less than 9,800 square feet shall be provided for the outdoor <br />play area, and the area shall be enclosed with a fence at least four feet in height. <br /> <br />(e) <br /> <br />The applicant shall maintain nineteen paved, on-site parking <br /> <br />spaces. <br /> <br /> (f) The proposed modular unit shall be equipped with fire extinguishers <br />and pull stations as required by the Fire Department. <br /> <br /> (g) The facility shall submit to all required inspections by the Fire <br />Department and the Building Official and shall correct any noted deficiencies. <br /> <br /> (h) The facility shall comply with all applicable federal <br />codes, ordinances and regulations and shall obtain and shall maintain <br />necessary licenses and permits. <br /> <br />state, and local <br />~n effect all <br /> <br /> (i) All taxes and fees on the subject property and the operation shall <br />be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br />Abstained: Griffin <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />99- 69(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO HELENA ROBINSON FOR THE <br />OPERATION OF A CHILD DAY CARE FACILITY AT 2115 HIGH STREET. <br /> <br /> WHEREAS, Helena Robinson has made application pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use <br />permit to operate a child day care facility at 2115 High Street, Portsmouth, Virginia; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing <br />or working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property <br />or improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility <br />with surrounding uses; <br /> <br /> <br />
