April 13, 1999 (b) The facility shall comply with the submitted site plan, floor plan, and building elevation identified respectively as Exhibits A, B, and C, attached hereto and made a part hereof. (c) Indoor operations shall be limited to the hours between 6:00 A.M. and 6:00 P.M., Monday through Friday. Outdoor play hours shall be limited to the hours between 10:00 A.M. and 6:00 P.M. (d) No less than 9,800 square feet shall be provided for the outdoor play area, and the area shall be enclosed with a fence at least four feet in height. (e) The applicant shall maintain nineteen paved, on-site parking spaces. (f) The proposed modular unit shall be equipped with fire extinguishers and pull stations as required by the Fire Department. (g) The facility shall submit to all required inspections by the Fire Department and the Building Official and shall correct any noted deficiencies. (h) The facility shall comply with all applicable federal codes, ordinances and regulations and shall obtain and shall maintain necessary licenses and permits. state, and local ~n effect all (i) All taxes and fees on the subject property and the operation shall be paid when due. 4. Ayes: Benn, Pitts, Robinett, Whitehurst, Holley Nays: None Abstained: Griffin Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to adopt the following resolution, and was adopted by the following vote: 99- 69(b): "A RESOLUTION GRANTING A USE PERMIT TO HELENA ROBINSON FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 2115 HIGH STREET. WHEREAS, Helena Robinson has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child day care facility at 2115 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting the application for an amended use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses;
