78 <br /> <br />March tl, 1975 <br /> <br />(d) <br /> <br />merit of property along the south side o~ Powell Street east of Haysom Street, and <br />(6) if t~ owne~ extends, the sidewal'k from ~_ortsmouth.Baulevar& into this group hous <br />ing project; and <br />The site plan provides for adequate facilities to serve the needs of the con- <br />templated 54 families." <br /> <br />Motion of Mr. Barnes and seconded by Mr. Early, to adopt the following resolution: <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br />40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, SUCH PROJECT BEING KNO}~ AS COACH <br />HOUSE APARTMENTS AND DESIGNATED AS GHP-?4-2. <br /> <br /> WHEREAS, Yates & Berkeley Associates, Ltd,, Architects and Hassell and Folkes Surveyors <br />Engineers have made application pursuant to Section 40-55 of the Code of the City of Portsmout <br />1973, as amended, for the granting of approval for a group housing project known as Coach Hous <br />Apartments (GHP-74-2); and <br /> <br /> WHEREAS, the application for same has been determined by the Planning Commission to have <br />met the requirements of said Section 40-55; and <br /> <br /> WHEREAS, the Planning Commission has reviewed such application and the site plans sub- <br />mitted ~herewith and has recommended approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of a group housing project pursuant <br />to said Section 40-55 grants only an exemption from certain dimensional requirements for re- <br />sidences as stated in the appropriate section of Article VI of Chapter 40 of the Code of the <br />City of Portsmouth and does not constitute a waiver of any other requirements embodied in the <br />Code of the City of Portsmouth and any other applicable state or federal laws; and <br /> <br /> WHEREAS, the developer is aware that building permit and/or any other required permits <br />will be issued only upon compliance with ordinances or laws applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that that certain group housing project known as Coach House Apartments, Portsmouth, Virginia <br />and designated as GHP-74-2 and more specifically shown on a plat entitled "Coach House Apart- <br />ments'' dated March 1975, prepared by Yates & Berkeley, and attached hereto and made a part <br />hereof, is hereby granted approval." <br /> <br /> B~fGre action was taken on this matter, Mayor Davis advised the City Council that be- <br />cause of personal interest, he would ncr enter ih discussion pertaining to same; he requested <br />that the Vice Mayor preside on the matter. <br /> <br /> Substitute motion of Mr. Early and seconded by Mr. Elliott, that the matter be deferred <br />and the City Manager furnish for proper coordination and re-submission to City Council, was <br />adopted by 6-0, with Mayor Davis abstaining. <br /> <br /> 75-115 ~r; Wentz informed the Council that JoseFh E. Parker tenure his resignation as <br />a member of the School Board. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Wentz to be referred to a conference, was adopte~ <br />by unanimous vote. <br /> <br /> 75-116 Motion of Mr. Elliott and seconded by Mr~ Wentz, that the Council meet in an <br />executive session prior to the next regularly scheduled Council meeting for the purpose of: <br /> <br />(1) Discussing appointments to Boards and Commissions; <br />(2) Discussing the disposition of City property; <br />(3) Consultation with Counsel pertaining to legal matters; <br /> <br />was adopted by the following vote: <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br />75-117 Councilman E. Saunders Early~ Jr~-Pr~septe&~the following resoluti6n: <br /> <br />'~ RESOLUTION EXPRESSING THE CONCERN OF THE CITY COUNCIL FOR TI~ PUBLIC SAFETY <br />OF THE RESIDENTS OF THE CITY OF PORTSMOUTH AND TIDEWATER, RESULTING FROM THE <br />NUMEROUS RECENT ESCAPES FROM THE JAIL OF THE CITY OF PORTSMOUTH BY DANGEROUS <br />PRISONERS; URGING THAT THE SHERIFF OF THE CITY OF PORTSMOUTH AND OTHER RESPONSI- <br />BLE PUBLIC OFFICIALS TAKE WHATEVER ACTION IS NECESSARY TO STUDY AND CORRECT THE <br />EXISTING DEFICIENCIES TO ELIMINATE SUCH CONCERN FOR PUBLIC SAFETY. <br /> <br /> WHEREAS, recently a number of dangerous prisoners have escaped from the jail of the City <br />of Portsmouth; and <br /> <br /> WHEREAS, the residents of the City of Portsmouth and Tidewater are concerned for the <br />public safety as a result of dangerous escaped prisoners being at large; and <br /> <br /> WHEREAS, the control of the security of the jail is the responsibility of the Sheriff <br />of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the Council does express its grave concern for the public safety of the residents of the <br /> <br /> <br />
