<br /> WHEREAS, the City of Portsmouth in conjunction with redevelopment activities in Southsid~
<br />under the 1974 Community Development Program has scheduled for de3ication to Portsmouth
<br />Redevelopment and Housing Authority the hereinafter described parcels; and
<br />
<br /> }~EREAS, the conveyance of these
<br />its maintenance of effort requirement
<br />Community Development Act; and
<br />
<br />parcels will enable the City of
<br />in accordance with the rules and
<br />
<br />Portsmouth to meet
<br />regulations of the
<br />
<br /> WHEREAS, Section 2.09(c) of the Charter of the City of Portsmouth provides that the
<br />City may convey property to the Commonwealth of Virginia, or any political subdivision thereoJ
<br />,,'ithout advertisement and without receiving bids; and
<br />
<br /> ~RBAS, the Portsmouth Redevelopment and Housing Authority is a political subdivision
<br />of the Commonwealth of Virginia.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is authorized to convey the following described property
<br />to the Portsmouth Redevelopment and Housing Authority:

<br />PARCEL A
<br />
<br /> All that certain lot, piece or parcel of land, with its appurtenances,
<br />situate in the City of Portsmouth, Virginia, and known, numbered and
<br />designated as Lot 21, Block 1, on the plat of Oakden, which plat is recorded
<br />in the Clerk's Office of the Circuit Court of the City of Chesapeake,
<br />Virginia, in Map Book 2, at page 40, and being more particularly described as
<br />~ollows: Beginning at the northeastern intersection of Sixth Street and
<br />Edwards Street; thence running North along the eastern side of Sixth Street
<br />30 feet 3 inches; thence easterly 90 feet; thence southerly and parallel
<br />with Sixth Street 30 feet 3 inches to Edwards Street; thence westerly
<br />along the northern side of Edwards Street 90 feet to the point of beginning.

<br />
<br /> All that certain lot, piece or parcel of land, with its appurtenances,
<br />situate in the City of Portsmouth, Virginia, and bounded and described
<br />as follows, to-wit: Beginning at a point on the northern side of Wythe
<br />Street 25 feet West from the eastern side of Fourth Street should it ex-
<br />tend northwardly; thence running West along Wythe Street 6 feet; thence
<br />North 150 feet, more or less, to the center of the channel of Crabb
<br />Creek; thence East along the center of the channel of Crabb Creek 6 feet;
<br />~hence south 150 feet, more or less, to the northern side of Wythe Street,
<br />the point of beginning.

<br />
<br /> All that certain lot, piece or parcel of land, with its appurtenances,
<br /> situate in the City of Portsmouth, Virginia, and bounded and described
<br /> as follows, towit: Beginning at a point on the northern side of Wythe
<br /> Street 24.7 feet East from the point where the western line of Fourth
<br /> Street would strike, if extended northerly; thence running northerly
<br /> 150 feet, more or less, to the Port Warden's line of Gander Creek; thence
<br /> easterk¥1~ndn~allele~i~ Wythe Street 6 feet; thence southerly 150 feet,
<br /> more or less, to Wythe Street; thence Westerly along Wythe Street 6 feet
<br /> to the point of beginning.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to
<br />all transactions and execute all documents incident to such conveyances."

<br /> 75-339 - "Consideration of a resolution to authorize the acquisition of certain property
<br />under eminent domain proceedings, such property beingCnecessary for the construction, altera-
<br />tion and maintenance of the Gander Creek drainage project.
<br />
<br /> The City of Portsmouth has been unable to purchase property located in the Gander Creek
<br />drainage project and it is necessary that such project be completed forthwith. Since the
<br />owners and the City have not been able to agree upon the price to be paid for such property,
<br />condemnation proceedings are necessary to acquire the needed land. The City Manager recom-
<br />mends adoption."

<br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was
<br />adopted, and by the following vote:

<br />"A RESOLUTION TO PROVIDE F.OR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOS~.IN PROCEEDINGS PURSUANT TO CP~PTER
<br />471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br />THE CONSTRUCTION, ALTE~iTION AND MAINTENANCE OF THE GANDER CREEK DkilNAGE
<br />PROJECT NEAR WASHINGTON STREET.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinaft{
<br />specified in and to the hereinafter described parcel of land situate in the City of Ports-
<br />mouth, Virginia, for the purpose of constructing, atter%pg and maintaining the Gander Creek
<br />Drainage Project; and
