198 <br /> <br />September 9, 1975 <br /> <br /> WHEREAS, Warren ttolland, Sr., et als have made application to vacate and close the <br />hereinafter described portion of a certain street, and it appearing that the notice of the <br />application and request for appointment of viewers was duly posted August 12, 1975, on the <br />bulletin board of the Circuit Court of the City of Portsmouth, and at two other public places <br />within the City of ~ortsmouth, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, Raymond Tweed, Louis J. Leitner, Zalmon I. Blachman and James L. <br />Choate be appointed viewers to view the hereinafter described portion of such street and <br />to report to this Council in writing whether in their opinion, any, and if any, what inconven <br />ience would result in vacating and closing the following: <br /> <br /> Ail of the street known as Westmoreland Avenue which lies South of <br />~iffin Street, extending to its end in Baines Creek, as shown on City <br />Tax Plate 322." <br /> <br />Ayes: Barnes, <br />Nays: None <br /> <br /> 75-387 "Consideration <br />Race Street." <br /> <br /> Early, Elliott, Holley, Wentz, Davis <br /> <br />of a resolution appointing viewers for closing a portion of <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Blliott, the following resolution was adoptedi, <br />and by the following vote: <br /> <br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF RACE STREET WHICH <br />LIES WEST OF PO~{ATAN AVENUE, EXTENDING TO ITS END IN BAINES CREEK. <br /> <br /> WHEREAS, Warren Holland, Sr., Helen D. Brandon and Norman S. Jenkins, et ux have made <br />application to vacate and close the hereinafter described portion of a certain street, and <br />it appearing that the notice of the application and request for appointment of viewers was <br />duly posted August 12, 197S, on the bulletin board of the Circuit Court of the City of Ports- <br />mouth, Virginia, the bulletin board of the Municipal Court, Civil Division of the City of <br />Portsmouth and the bulletin board of the Council Chambers of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, Raymond Tweed, Louis J. Leitner, Zalmon I. Blackman and James L. <br />Choate be appointed viewers to v~ew the hereinafter described portion of such street and <br />to report to this Council in writing whether in their opinion, any, and if any, what inconven <br />ience would result in vacating and closing the following: <br /> <br /> All of the street known as Race Street which lies west of Powhatan <br />Avenue, extending to its end in Baines Creek, as shown on City Tax Plate 322." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Wentz, Davis <br /> Nays: None <br /> <br /> 75-388 "Consideration of a resolution to acquire under eminent domain proceedings <br />property necessary for the construction and alteration and widening of Wool Avenue~ <br /> <br /> This property is necessary for the completion of the improvements authorized for the <br />Wool Avenue section of the Mount Hermon Conservation and Redevelopment Project, Va. R-69. <br />This action is necessary due to title problems and the fact that present owners of record <br />cannot be located. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and secondedbby Mr. Early, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY <br /> OE PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO C~PTER <br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE <br /> CONSTRUCTION, ALTERATION AND WIDENING OF WOOL AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafter <br />specified in and to the hereinafter described parcel of land situate in the City of Ports- <br />mouth, Virginia, for the purpose of constructing, altering and widening Wool Avenue. <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase <br />herein, necessary to the project, because of a defect in the title <br />the present record owners cannot be located. <br /> <br />the property described <br />to the .property in that <br /> <br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably <br />if said property is not made available as soon as possible. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute eminent domain proceedings against the <br />following property situate in the City of Portsmouth, for the purpose of acquiring fee simple <br />title therein, together with any and all easements of ~ccess, light or air incident to the <br />lands of the landowner abutting upon said property, in accordance and pursuant to Sections <br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of <br />Assembly of 1970, as amended), and to deposit to the credit of the Clerk of the Circuit <br />Court of the City of Portsmouth as provided by law the sum hereinafter specified to compensat <br />the o~mers of the parcel of land known, numbered and designated as Parcel 15 as shown on <br /> <br /> <br />
