238 <br /> <br />October 28. 1975 <br /> <br /> "A RESOLUTION ASSURING TF~T 'THE CITY WILL DEVELOP AND MAINTAIN AN INDUSTRIAL COST <br /> RECOVERY SYSTEM WHICH SF~LL REQUIRE ALL INDUSTRIAL USERS TO PAY TIt~T PORTION OF <br /> THE GRANT AMOUNT ALLOCABLE TO THE TREATMENT OF WASTES FROM SUCH USERS: ASSURING <br /> TEE CITY WILL REVISE ITS USER CHARGE SYST~4 IF DISAPPROVED BY THE EN~-IRONMENTAL <br /> PROTECTION AGENCY. <br /> WHEREAS, the City has applied for a grant to upgrade the sewage treatment plant;' and <br /> WHEREAS, to receive such grant, certain assurances must be made to the Environmental Protection <br />Agency. <br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City of Portsmouth, Virginia will develop and maintain an industrial cost recovery system whict <br />shall require all present and future industrial users to pay that portion of the grant amount <br />allocable to the treatment of wastes from such users in conformance with 40 CFR 35.92B. <br /> BE IT FURTHER RE~0L¥BD~bythe~Cou~¢il~of~th~ gity of Portsmouth, Virginia, that should En-. <br />vironmental Protection Agenc~ disapprove the s?stem for not conforming with 40 CFR 35.93S-13, <br />the City of Portsmouth, Virginia, will revise the system ~o conform with 40 CFR 35.95S-13 according <br />to the following schedule and that said system will be maintained. <br /> A encv fdr <br /> (1) User charge system to be redrafted and submitted to Environmental Protection g <br /> preliminary review and comment within Three Hundred (3OO) days after acceptance of the grant <br /> o~f~r~ <br /> (2) Submission of revised user charge system to appropriate governmental entity(les) for <br /> adoption within Sixty (60) days of receipt of Environmental Protection Agency's comment on <br /> draft. <br /> <br />Name(s) of entity(les). <br /> <br /> City Council, <br /> (S) Adoption of revised user charge system by appropriate governmental entity(les) within <br />Thirty ($O) days after submission for adoption. <br /> (4) Submission of adopted revised user charge system to Environmental Agency for review <br />and approval within Thirty (SO) days after adoption of system." <br /> <br /> Ayes: Barnes, Early, Elliott, east, Wentz, Davis <br /> Nays: None <br /> <br /> 75-471 "Consideration of a resolution authorizing the City Manager to convey City-owned <br />property to Portsmouth Redevelopment and Housing Authority. <br /> The property to be transferred was purchased as right-of-wgy f?r the installation of the <br />Gander Creek drainage system. That portion of"'the property which ~s not required for the <br />Gander Creek drainage is being transferred as part of the Southside Community Development <br />Prelect for reuse. The City Manager recommends adoption." <br /> and b~nt~%t~%~l%~l~'v~es and seconded by Mr. Elliott, the following resolution was adopted~ <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO CObPfEY CITY O~ED PROPERTY TO PORTS- <br /> MOUTH REDEVELOPMENT AND HOUSING AUTHORITY. <br /> WHEREAS, the City of Portsmouth purchased certain property from Samuel J. Russo in connec= <br /> tion with the construction and maintaining of the Gander Creek Project; and <br /> WHEREAS, all of the surrounding property is owned, or will be o~med by Portsmouth Redevelop- <br /> ment and Housing Authority as property to be used in the Southside I Redevelopment Project; <br /> and <br /> WHEREAS, said parcel of property is not needed by the City of Portsmouth; and <br /> ~HERBAS, Portsmouth Redevelopment and Housing Authority is a political subdivision of <br /> the Commonwealth of Virginia. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br /> the City Manager be, and he hereby is, authorized to convey the following described property <br /> to Portsmouth Redevelopment and Housing Authority: <br /> Ail that certain lot, piece or parcel of land, situate, lying and being <br /> in the City of Portsmouth, Virginia, more particularly described as follows: <br /> . Beginning at a ~oi~t ~n the eaStern~right of way of Washington. Street, <br /> samd point being NOS $3 SO West 116.O0 feet from the northeast <br /> ~: Qf Washington Street and Scott Str.eet; thence continuing north O3°33'30" West <br /> 29.00 feet~to a point; thence N86°26'$O" East 120 feet to a point; thence <br /> S0~°33'50'~ East 29.00 ~feet to a point; ]thence S86~26'30" ~est't20 feet to a <br /> point on the eastern margin O!~ashington Street, the point Of beginning. <br /> <br /> BE IT FURTHER RESOLVED that the City ~anager be, and he hereby is, authorized to complete <br /> all transactions and execute all documents incident to such conveyances." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Wentz, Davis <br />Nays: None <br /> <br /> <br />
