234 October 28. 1975 75-435- The following ordinance, deferred from regular meeting of October 14, 1975, was.taken up and read: "AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY ~MFNDING SECTION 31-162 OF C}~PTER 31 THEREOF, PERTAINING TO REDUCTION OF DISABILITY RE- TIREMENT ALLOWANCE." On motion of Mr. Wentz and seconded by Mr. Early, the ordinance was adopted, and by the following vote: Ayes: Early, Oast, Wentz, Davis Nays: Barnes, Elliott The following reports from the City Manager were presented: 75-458 '~lease find attached a copy of the 1976 Community Development Program which was prepared by the Community Development Task Force. The Community Development Task Force consists of: 1. The City Manager 2. The Fxecutive Director of P.R.H.A. 3. The Assistant City Manager 4. The Deputy Director of P.R.H.A. 5. The Director of Economic Analysis & Information 6. The Director of Planning & Program Development P.R.H.A. We have met on several occasions to review the recommendations of the Citizens Advisory Committee, as well as our ongoing Community Development activities. We feel that the program we are submitting to you incorporates the priorities of the Citizens Advisory Committee, as well as those of the Community Development Task Force. Last but not least, the 1976 Community Development Program as outlined will meet the ~ objectives and regulations of the Housing and Community Development Act of 1974. We are plea ed with the contents of this program and hope to achieve the same quality for 1976 that was presdnt in 1975. Your recommendation and approval of this program will enable us to file an application I with the Department of Housing and Urban Development for the 1976 Community Development funds." On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was adopted, and by the following vote: "A RESOLUTION APPROVING THE 1976 COM~NITY DEVELOPMENT PROGRAM AND AUTHORIZING THE ~YOR AND CITY MANAGER TO FILE AN APPLICATION THEREFOR. WHEREAS, under the provisions of the Housing and Community Development Act of 1974, fi- nancial assistance is provided to localities for undertaking and carrying out community development activities; and WHEREAS, this Citizens Advisory Commission has reviewed and held public hearings on a 1976 Community Development Program in'the City of Portsmouth and related redevelopment proposa and WHEREAS, it is necessary that this council take appropriate official action respecting said program to comply with the regulations of the aforementioned Act; and WHEREAS, this Council is cognizant of the conditions that are imposed in the undertaking and carrying out of activities under the Community Development Program; and WHEREAS, this Council, on behalf of the City of Portsmouth, possesses the legal authorit) to apply for a grant and execute the proposed program under the provisions of the aforementior Act; and WHEREAS, this Council recognizes its responsibility to direct that safeguards be estab- lished to prohibit employees from using their positions for a purpose that is or given the appearance of being motivated by a desire for private gain for themselves or others, particu- larly those with ~om they have family, business or other ties. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the 1976 Community Development Program has been reviewed and considered and hereby is, ap- proved in all respects and that the mayor and City Manager be, and they hereby are autho- rized to file an application and such additional information as may be required for the City's full 1976 entitlement totalling $4,S70,O00. under this program. BE IT FURTHER RESOLVED that the Mayor and the City Manager are designated as the Certify- ing Officers and authorized representatives, of the City of Portsmouth and shall provide as- surances as required by the regulations of the Housing and Community Development Act of 1974 for the approval and execution of such program. BE IT FURTIiER RESOLVED that the Mayor and the City Manager be, and they hereby are, authorized and directed to give the Department of Housing and Urban Development and the Comp- ~m~l~r~meral through any authorized representative access to and the right to examine all records, books, papers, or documents related to the grant. ls;
