234 <br /> <br />October 28. 1975 <br /> <br /> 75-435- The following ordinance, deferred from regular meeting of October 14, 1975, <br />was.taken up and read: <br /> <br /> "AN ORDINANCE TO ~MEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, BY ~MFNDING <br /> SECTION 31-162 OF C}~PTER 31 THEREOF, PERTAINING TO REDUCTION OF DISABILITY RE- <br /> TIREMENT ALLOWANCE." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Early, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Early, Oast, Wentz, Davis <br />Nays: Barnes, Elliott <br /> <br />The following reports from the City Manager were presented: <br /> <br /> 75-458 '~lease find attached a copy of the 1976 Community Development Program which <br />was prepared by the Community Development Task Force. The Community Development Task <br />Force consists of: <br /> <br />1. The City Manager <br />2. The Fxecutive Director of P.R.H.A. <br />3. The Assistant City Manager <br />4. The Deputy Director of P.R.H.A. <br />5. The Director of Economic Analysis & Information <br />6. The Director of Planning & Program Development P.R.H.A. <br /> <br /> We have met on several occasions to review the recommendations of the Citizens Advisory <br />Committee, as well as our ongoing Community Development activities. We feel that the <br />program we are submitting to you incorporates the priorities of the Citizens Advisory <br />Committee, as well as those of the Community Development Task Force. <br /> Last but not least, the 1976 Community Development Program as outlined will meet the ~ <br />objectives and regulations of the Housing and Community Development Act of 1974. We are plea ed <br />with the contents of this program and hope to achieve the same quality for 1976 that was presdnt <br />in 1975. <br /> Your recommendation and approval of this program will enable us to file an application I <br />with the Department of Housing and Urban Development for the 1976 Community Development funds." <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION APPROVING THE 1976 COM~NITY DEVELOPMENT PROGRAM AND AUTHORIZING <br /> THE ~YOR AND CITY MANAGER TO FILE AN APPLICATION THEREFOR. <br /> <br /> WHEREAS, under the provisions of the Housing and Community Development Act of 1974, fi- <br />nancial assistance is provided to localities for undertaking and carrying out community <br />development activities; and <br /> <br /> WHEREAS, this Citizens Advisory Commission has reviewed and held public hearings on a <br />1976 Community Development Program in'the City of Portsmouth and related redevelopment proposa <br />and <br /> <br /> WHEREAS, it is necessary that this council take appropriate official action respecting <br />said program to comply with the regulations of the aforementioned Act; and <br /> <br /> WHEREAS, this Council is cognizant of the conditions that are imposed in the undertaking <br />and carrying out of activities under the Community Development Program; and <br /> <br /> WHEREAS, this Council, on behalf of the City of Portsmouth, possesses the legal authorit) <br />to apply for a grant and execute the proposed program under the provisions of the aforementior <br />Act; and <br /> <br /> WHEREAS, this Council recognizes its responsibility to direct that safeguards be estab- <br />lished to prohibit employees from using their positions for a purpose that is or given the <br />appearance of being motivated by a desire for private gain for themselves or others, particu- <br />larly those with ~om they have family, business or other ties. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the 1976 Community Development Program has been reviewed and considered and hereby is, ap- <br />proved in all respects and that the mayor and City Manager be, and they hereby are autho- <br />rized to file an application and such additional information as may be required for the City's <br />full 1976 entitlement totalling $4,S70,O00. under this program. <br /> <br /> BE IT FURTHER RESOLVED that the Mayor and the City Manager are designated as the Certify- <br />ing Officers and authorized representatives, of the City of Portsmouth and shall provide as- <br />surances as required by the regulations of the Housing and Community Development Act of 1974 <br />for the approval and execution of such program. <br /> <br /> BE IT FURTIiER RESOLVED that the Mayor and the City Manager be, and they hereby are, <br />authorized and directed to give the Department of Housing and Urban Development and the Comp- <br />~m~l~r~meral through any authorized representative access to and the right to examine <br />all records, books, papers, or documents related to the grant. <br /> <br />ls; <br /> <br /> <br />
