The permit for the water tremtment plant waste discharge <br />requires that a plan for abatement of the present discharge into Lake Meade be submitted by <br />May 1, 1976. The City has been seeking Federal assistance in connection with this project <br />and has been unsuccessful to date. Therefore, it is recommended that we proceed with the <br />preliminary design to meet the provisions of our N.P.D.E.S. permit. The City Manager recom- <br />mends adoption on first reading. <br /> On motion of Mr. Barnes and seconded by Mr. Halley, the following ordinance was approved <br />on ~irst reading, and by unanimous vote. <br /> <br /> "AN ORDINANCE TO APPROPRIATE $150,000 FRO~ THE CAPITAL IMPROVEMENT FUND <br /> FOR ENGINEERING COSTS, PRELIMINARY STUDY AND DESIGN OF CAPITAL IMPROVEMENTS <br /> TO THE GODWIN STREET AND LAKE KILBY PUMP~ STATIONS." <br /> <br /> 76-76 "Consideration of an ordinance amending the City Code pertaining to off-site <br /> drainage improvements, including only those improvements paid for by local funds. <br /> ~ This ordinance will amend the off-sit~ drainage ordinance to establish criteria for de- <br /> termining the proportionate share to be paid by the developers. Under this amendment, the <br /> developer would be required to pay his proportionate share of the cost on the amount 6~fl6cal <br /> funds used in the construction of off-site drainage. Off-site drainage improvements construct <br /> ed with State ~r Federal funds will not be used in the calculations of the pro-rata share for <br /> the developers. The City Manager recommends adoption." <br /> <br /> The following letter from the City Attorney was presented: <br /> "The Off-site Drainage Ordinance as written draws no exception as to developers' pro <br /> rat~ c~her~B~tl6~cfDr the construction of off-site drainage paid for by Federal or State Funds <br /> The p?hposed Ordinance will exclude from the calculations to determine the pro rata <br /> share for the construction of off-site drainage, Federal and State grant funds. The proposed <br /> amendment will be helpful in the redevelopment of the City by reducing the construction costs <br /> of private developers." <br /> On motion of Mr. Early and seconded by Mr. Halley, the following ordinance was adopted <br /> on first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE AMENDING SECTION 33-56 OF THE CITY CODE PERTAINING TO OFF-SITE <br /> DRAINAGE IMPROVEMENTS INCLUDING ONLY THOSE IMPROVEMENTS PAID FOR BY LOCAL FUNDS. <br /> <br /> Ayes: Early, Elliott, Halley, Oast, Wentz <br /> Nays: Barnes <br /> <br /> 76-77 Cons~deratmon of an ordinance closing a portion of ~lorida Avenue between High <br />Street and King Street. <br /> <br /> ~ Portsmouth Redevelopment and Housing Authority applied to vacate a part'ion of Florida <br />Avenue between High Street and King Street.
