308 <br /> <br />February 24, 1976 <br /> <br /> 76-44 - On motion of Mr. Barnes and seconded by Mr. Early, the following ordinance <br />approved on first reading at the Public Hearing meeting of February 9, 1976, was adopted, <br />and by the following vote: <br /> "AN ORDINANCE AMENDING THE ZONING Y~AP OF THE CITY OF POrtSMOUTH, VIRGINIA, <br /> TO REFLECT A]vIENDMENTS OF ZONING CLASSIFICATIONS OF CERTAIN DESCRIBED <br /> PROPERTIES HEREIN." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast <br /> Nays: None <br /> Abstaining: Wentz <br /> <br /> T~e-~ollawing letter received from Benjamin Harrison, owner of Harrison's Moving & <br />Storage Co., Inc., dated January 26, 1976, pertaining to above ordinance: t <br /> "I received a notice in reference to a rezoning in which is listed to come before the <br />Councilmen February 9, 1976 at ~:30 p.m., docketed as Z-76-2 for the rezoning of land with <br />boundries from Lincoln Street to Jefferson Street. Sixth Street to Seventh Street to <br />Residential R-60. <br /> I would like at this time to let it be known that I am not opposing this personally <br />as such, but I feel that the Portsmouth Redevelopment & Housing Authority and the City Council <br />should be made aware of a problem that has existed in the past and with this proposal will <br />constitute a great problem in the future. <br /> Harrison's Moving ~ Storage Company is located on property that is zoned light industry,I <br />and does consist of a business that comes under this category, and it is basically a 24 hour I <br />a day operation of business. In the past quite a few residents bordering this operation has I <br /> ined about, the motor noise at night from vehicles, in which part of them are large <br />compla . . , <br />diesel vehicles and realizing that they~had a legimate complaint about the no,se I bought some <br />of those peoples property, but I also realize that with this pro,oct planning to be built <br />bordering my premises that it is going to constitute more complaints. I thought that it <br />should be brought to all parties attention, so that in the future if this project is put into <br />effec~ that at least you will be familiar with same and I will have someone to send these <br />people to with their complaints. <br /> <br /> Therefore, I would like for my concern in reference to this be made a part of the record <br /> in reference to this hearing. <br /> <br /> Again, I would like to point out that this is not a personal complaint, only trying to <br /> point out s~me fa~ts before an expensiv.e project is put into effect with no apparent solution <br /> to a very antagonizing situation." <br /> <br /> 76-45 - The following ordinance approved on first reading at the Public tlearing meeting <br /> of February 9, 1976, was taken up and read: <br /> <br />the <br /> <br /> "ZONING ~ENDMENT <br /> <br />On motion of Mr. <br />following vote: <br /> <br /> Ayes: <br /> Nays: <br /> <br /> 76-45 <br />approved on <br />and <br /> <br /> ORDINANCE Z 76-1" <br /> <br />Early and seconded by Mr. Elliott, the ordinance was adopted, and by <br /> <br />Barnes, Early, Elliott, Holley, Oast, Wentz <br />None <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Holley, the following resolution, <br /> first reading at the Public Hearing meeting of February 9, 1976, was ~dopted, <br />by the following vote: (UP 76-1) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO OPERATE SCRAP PROCESSORS' YARD ON <br />CERTAIN PROPERTY SITUATE NEAR THE INTERSECTION OF SYMR ROAD AND SPRUCE STREET. <br /> <br /> WHEREAS, Virginia Iron and Metal Company has made an application pursuant to Section <br />40-69(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use <br />permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to be <br />done in connection with said application, and the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (a) That the use for which the use permit hereinafter described is sought (1) will <br />not adversely affect the health or safety of persons residing or working in the neighborhood <br />of the proposed use, (2) will not be detrimental to the public welfare or injurious to propel <br />or improvements in the neighborhood, and (3) will be ~n accord with the purposes of the Zonin <br />Chapter of the City Code. <br /> <br /> (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40~6~b) <br />of the City Code to operate a scrap processors' yard on the property described as follows: <br /> <br /> Beginning at the southeast corner of Spruce Street and Syer Road; <br /> thence northerly along the south right-of-way line of Spruce Street approximately <br /> 250 feet to the west right-of-way line of the Norfolk and Portsmouth Belt Line <br /> Railroad; thence south along said railroad right-of-way approximately 8OO feet <br /> to the north right-of-way line of the Seaboard Coast Line Railroad thence westerly <br /> along said railroad right-of-way approximately 4S feet to the east right-of-way <br /> <br />ty <br /> <br /> <br />
