340 <br /> <br />27. 1976 <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required <br />to be done in connection with said application, and the Planning Commission has recommended <br />the granting of said use permit on condition. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> (a) That the use for which the use permit hereinafter described is sought (1) will <br />not adversely affect the health or safety of persons presiding or working in the neighbor- <br />hood of the proposed use, (2) will not be detrimental to the public welfare or injurious <br />to property-or improvements in the neighborhood, and (3) will be in accord with the pur- <br />poses of the Zoning Chapter of the City Code. <br /> (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- <br /> 73(b) of the City Code to operate a marina on the property described as follows: <br /> Beginning approximately 180 feet west of the southwest corner of Adams <br /> Street and Robinhood Avenue; thence southerly approximately 460 feet to a <br /> line of the Western Branch of the Elizabeth River; thence West approximately <br /> 120 feet to a point; thence Northerly approximately 470 feet to the south <br /> right of way line of Adams Street; thence east along said right of way approxi- <br /> mately 120_f¢et3to the point of origin. <br /> (c) The granting of this use permit is subject to the following conditions: <br /> The applicants have one (1) year in which to prepare a site plan and have them approved <br /> by the Planning Commission and the City Council.
