387 <br /> <br />July 13~ 1976 <br /> <br /> On motion of Mr. Nolle¥ and seconded 5y Mr. Elliott, the following ordinance was approve~ <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE ~12,600 FROM THE CAPITAL IMPROVEMENT FUND FOR <br />REPAIRS AND IMPROVEMENTS TO THE PORTSMOUTH DAY CARE CENTER." <br /> <br /> 76-272 "Co ' ' <br /> nslderatlon of an ordinance on first reading to appropriate $4,160 from <br />the Capital Improvement Fund for the demolition of sections of abandoned and closed streets <br />in the Mount Hermon Urban Renewal Project. <br /> <br /> This appropriation will provide for the removal of concrete sidewalks, curbing, asphalt <br />and pavement to allow for the construction of residential dwellings in accordance with the <br />redesigned project area. This project was included as part'of the Capital Improvement Work <br />Program for Mount Hermon Urban Renewal Project for 1976-77. The City Manager recommends <br />adoption on first reading." <br /> <br /> On motion of Mr. Barnes and seconded by ~4r. Elliott, the following ordinance was ap- <br />proved on first reading, and by 5-1 (Wentz abstaining) vote: <br /> <br /> "AN ORDINANCE TO APPROPRIATE $4,160 FROM THE CAPITAl IMPROVEMENT FUND FOR <br /> DEMOLITION OF SECTIONS OF ABANDONED AND CLOSED STREETS IN THE MT. HERYL~N <br /> RENEWAL PROJECT." <br /> <br /> 76-273 "Consideration of an ordinance to amend the City Code by repealing that portion <br />pertaining to penalties for violation of motor vehicle and traffic regulations. <br /> <br /> This repeals a previous section of the City Code which was replaced by an ordinance <br />paralleling the State Code adopted by the City Council at the previous meeting. The City <br />Manager recommends adoption." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY REPEALING SECTION 23-23 THEREOF, PERTAINING TO PENALTIES FOR VIOLATION <br />OF MOTOR VEHICLE AND TRAFFIC GULATIONS. <br /> RE " <br /> <br />Ayes: Barnes, Early, Elliott, Holley, We~tz, Davis <br />Nays: None <br /> <br /> 76-274 "Consideration of an ordinance closing a portion of Reese Drive south of the <br />Nottingham Condominium (S-76-13). <br /> <br /> Nottingham Homes applied to close a portion of Reese Drive south of the Nottingham Con- <br />dominium. Council, by resolu~i6nnadopted June 22, 1976, appointed viewers. The viewers <br />report and map are attached for your information. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Early and seconded 5y Mr. Barnes, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br /> "AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF REESE DRIVE SOUTH OF <br /> NOTTINGHAM CONDOMINIUM (S-76-13)." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Wentz, Davis <br />Nays: None <br /> <br /> 76-275 "Consideration of a resolution approving the bids and low bidder of Stage II <br />of the Western Freeway and authorizing the City Manager to sign and the City Clerk to attest <br />th~ City's concurrence of such approval. <br /> <br /> The Virginia Department of Highways has advertised and submitted a list of the apparent <br />low bidders for the construction of the approaches to the Western Freeway Brid~e Included <br />in the City's A~i~&~%>~_.~fg~astruction costs in all categories except ~06% City cost <br />for actual ~rk to Be done on sanitary sewers and water mains. The total estimated co~t is <br />$2,813,000, with the City's share including the 100% items being $470,000. The City Manager <br />recommends adopt~an." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Wentz, the fellowing resolution was adopted <br />and by the following vote: ' <br /> <br /> A RESOLUTION APPROVING AND ACCEPIING THE LOW BID AND LOW BIDDER FOR CON- <br /> STRUCTION STAGE II, ROUTE 164, WESTERN FREEWAY (WESTERN FREEWAY BRIDGE) AND <br /> AUTHORIZING THE CITY MANAGER TO SIGN THE ACCEPTANCE OF THE LOW BID AND THE <br /> CITY CLERK TO ATTEST THE EXECUTION OF SUCH CONCURRENCE. <br /> <br /> WHEREAS, by agreement dated N~vember 21, 1975, the City of Portsmouth must toncur <br />in the award of contracts for construction of the Western Freeway; and <br /> <br /> WHEREAS, the apparent low bid and low bidder for construction Stage II is E. V. <br />Williams Company, Incorporated, Virginia Beach, Virginia. <br /> <br />WHEREAS, said low bid and low bidder has been accepted by the Department of Highways. <br /> <br /> <br />
