Saunders Early, Jr., Archie Elliott, Jr., James W. Holley, <br />Edward L. Oast, Jr., Robert W. Wentz, Jr., R. T. Williams, City Manager, Gordon <br />B. Tayloe, Jr., City Attorney. <br /> <br />Absent: Jack P. Barnes <br /> <br /> Mr. Bill Bates, Minister, Airline Boulevard Church of Christ, <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br /> Mayor Davis welcomed all visitors in attendance. · <br /> <br /> Motion of Mr. Wentz and seconded by Mr. Oast, minutes of the Public <br />August 9, 1976 and minutes of the regular meeting of August 10, 1976, to <br />received, was adopted by unanimous vote. <br /> <br />opened the meeting with <br /> <br />Hearing meeting of <br />be approved as <br /> <br />- UNFINISHED BUSINESS <br /> <br /> 76-315 The following ordinance iapproyed on first reading at the Public Hearing!meeting <br />of August 9, 1976, was taken up and read: <br /> <br />(a) "ZONING AMENDMENT ORDINANCE Z 76-15" <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Early, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Early, <br />Nays: None <br />Abstaining: Holley <br /> <br />Elliott, <br /> <br />Oast,.Wentz, Davis <br /> <br />· 76-315 - The following ordinance approved on first reading at the Public Hearing meeting <br />~'August 9, 1976, was taken up and read: <br /> <br />(b) "ZONING AMENDMENT ORDINANCE Z 76-18" <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the ordinance was adopted, and by <br />the following vote: <br /> <br /> Ayes: Early, Elliott, Oast, Wentz, Davis <br />Nays: None ~ <br />Abstaining: Holley . <br /> <br />approved on first reading at the Public Hearing meeting of August 9, 1976, was adopted, <br />by the following rote: <br /> <br />76-515 - on--motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution <br /> and <br /> <br />(c) <br /> <br />"A RESoLuTIoN GRANTING A USE PERMIT TO OPERATE AN AUTOMOTIVE SERVICE STATION <br />ON PROPERTY SITUATE ON THE SOUTH SIDE OF HARTFORD STREET BETWEEN PACIFIC <br />AVENUE AND CAMBRIDGE AVENUE. (UP-76-5). <br /> <br /> WHEREAS, Union Oil of California has made an application pursuant to Section 40- <br />70(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use <br />permit as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to <br />be done in connection with said application and the Planning Commission has recommended <br />the granting of said use permit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (a) That the use for which the use permit hereinafter described is sought (I) will <br />not adversely affect the health or safety of persons residing or working in the neighborhood <br />of the proposed use, (2) will not be detrimental to the public welfare or injurious to <br />property or improvements in the neighborhood, and (5) will be in accord with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- <br />70(b) of the City Code to operate an automotive service station on the property describ- <br />ed as follows: <br /> <br /> Beginning at the southwest corner of Hartford and Cambridge Streets; <br />thence running south along the west side of Cambridge Street 125 feet; <br />thence west 100 feet to a point; thence north 125 feet to the southside <br />pf Hartford Street; thence east along Hartford Street 100 feet to the point <br />of beginning. <br /> <br />(c) That the granting of this use permit is subject to the following condition: <br /> <br /> A site plan be prepared acceptable to the City of Portsmouth's Traffic Engineer in <br />terms of access to public streets and such site plans indicating compliance with all other <br />City Code provisions." <br /> <br />Ayes: Early, Elliott, <br />Nays: None <br />Abstaining: Holley <br /> <br />Oast, <br /> <br />Wentz, Davis <br /> <br /> <br />
