58 <br /> <br />October 12, 1976 <br /> <br />WHEREAS, by recordation of that certain subdivision plat entitled "Green Acres Section <br /> <br />8B", made by S. W. Armistead, C. E., dated December 12, 1949, recorded in the Clerk's Office <br />of the Circuit Court of Chesapeake (formerly Norfolk County) Virginia, in Map Book 32, page <br />72, a 10 foot drainage easement was dedicated on lots 196, 197, 198, 203, 204 and 205 of <br />said subdivision, a copy of which is attached hereto; and <br /> <br /> WHEREAS, said 10 foot drainage easement is no longer used or maintained by the City <br />of Portsmouth and serves only the use of the private property owners of said property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to execute such deeds and documents <br />of vacation and release as may be necessary to vacate and release the interest of the City <br />in said 10 foot drainage easement on property on Rolen Drive and Verne Avenue, Portsmouth, <br />Virginia." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, east, Wentz <br />Nays: None <br /> <br /> 76-416 "Consideration of a resolution amending a resolution adopted by City Council on <br />August 25, 1976, setting the next highway priorities as follows: <br /> <br />(1) Extension of the Western Freeway from the new Western Freeway Bridge to the <br /> mid-town tunnel. <br /> <br />(2) Extension of Victory Boulevard to Portsmouth Boulevard. <br /> <br />This amendment is necessary to include the language adopted by the State as a <br />standard resolution for committing to future projects. The major change is <br />the agreement that if the City decided to abandon the project in the future <br />that we agree toppay the Highway Department 100% of all costs incurred at the <br />time of abandonment. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Early, The following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION AMENDING RESOLUTION NO. 1976~:4 ADOPTED ON AUGUST 24, 1976 <br />PERTAINING TO THE SETTING FORTH THE CITY OF PORT~{OUTH'S HIGHEST HIGHWAY <br />PRIORITY PROJECT FOR STATE/CITY PARTICIPATION AND CO~4ITTING THE CITY TO <br />PAY ITS FIFTEEN PERCENT SHARE OF THE COST OF SUCH PROJECTS; THE AMENDMENT <br />REQUIRES THE CITY TO PAY THE DEPARTMENT OF HIGHWAYS AND TRANSPORTATION OF <br />THE COMMONWEALTH OF VIRGINIA ONE HUNDRED PERCENT OF TIiE COST INCURRED FOR <br />ANY PROJECT WHICH THE CITY DECIDES NOT TO PROCEED WITH. <br /> <br /> WHEREAS, on August 24, 1976, this Council adopted a resolution setting forth the City <br />of Portsmouth's highest highway priority projects for state/city participation and committed <br />the City to pay Fifteen (15) percent share of the cost of such projects; and <br /> <br /> WHEREAS, the State has requested an amendment to such resolution to provide that the <br />City commit to pay One hundred (100) percent of the cost incurred by the Department of Highway <br />and Transportation if the City decides not to proceed further with said project. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that <br />Resolution No. 1976-74 is amended by adding the following: <br /> <br />~The City further agrees that if the said project is established as herein <br />requested; and, thereafter, the said City decides not to proceed further with <br />the said project, then the City, by this Resolution, agree~ to repay the Depart- <br />~en~ of Highways and Transportation of the Commonwealth of Virginia for One <br />hundred (100) percent of the cost incurred for the said project to the time of <br />abandonment.' <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz <br /> Nays: None <br /> <br /> 76-417 "Consideration of an ordinance on first reading to appropriate $35,000 from <br />the Capital Improvements Fund for engineering costs to design separation of the Suffolk <br />District Water System from the Nansemond District Water System. <br /> <br /> This appropriation will provide the funds necessary to design the separation of the <br />water distribution lines in the Suffolk district from the distribution lines in the Nansemond <br />System. Based on notification under the current contract for the Suffolk district water syste <br />the City of Suffolk has provided notification to purchase this system must be separated from <br />the Nansemond system, since Suffolk has not committed to purchase the Nansemond system. The <br />City~anager recommends adoption on first reading. <br /> <br /> Consideration of a motion authorizing the City Manager to enter into engineering agree- <br />ments to accomplish the d~sign and separation of the system." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Early, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $35,000 FROM THE CAPITAL IMPROVEMENT FUND TO PAY <br />FOR EXPENSES INCURRBD IN SEPARATING THE WATBR DISTRIBUTION LINES OF THB OLD <br />CITY OF SUFFOLK FROM THE OLD COUNTY OF NANSEMOND." <br /> <br />Motion of Mr. Oast and seconded by Mr. Elliott, that authorization be granted,as requeste~ <br /> <br /> <br />
