The City Attorney is directed to institute eminent domain proceedings against the <br />following property situated in the City of Portsmouth, for the purpose of acquiring fee simple; <br />title therein, together with any and all easements of access, light or air incident to the <br />lands of the landowner abutting upon said property, in accordance and pursuant to Sections <br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of <br />Assembly of 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court <br />of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the <br />owners of the parcel of land designated on that certain plat entitled, "Plat Sho~ing Property <br />To_.BeAcquiredc~romlCra~ocktSkeet-Metal~an~Ko. efin~ ~o~pa~M~;_a~py or, said plat is:attached <br />hereto. <br /> <br /> 2. The name of the property owner is: Cradock Sheet Metal and Roofing Company." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br /> Nays: None <br /> <br /> - Consideration of a resolution to con~emn property belonging to Ruth Baldridge <br /> 76-433 " ' ' <br />Chappell." <br /> <br /> On marion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was adopted, <br /> and by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY <br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO C~PTER <br /> 471 OE THE ACTS OE ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR <br /> THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF PARADIS CREEK DRAINAGE PROJECT.~ <br /> <br /> ~HEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter <br /> specified in and to the hereinafter described parcel of land situate in the city of Portsmouth <br /> Virginia, for the purpose of constructing, altering and maintaining the Paradise Creek Drain- <br /> age Project; and <br /> <br /> ~tEREAS, the City of Portsmouth has not been able to purchase property described herein, <br /> necessary to the project, because the owners thereof in the City have not been able to agree <br /> upon price to be paid therefor; and <br /> <br /> ~HEREAS, advancement of the work and use of the said project will be delayed unreasonably <br /> if said property is not made available as soon as possible. <br /> <br /> NO~, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1.
