<br />         On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was adopted,
<br /> and by the following vote:
<br />
<br />      "A RESOLUTION TO PROVIDE'FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br />      OF PORTSMOUTH, VIRGINIA~ UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO C}~PTER
<br />      471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br />      THE CONSTRUCTION, ALTERATION AND WIDENING OF SYER ROAD.
<br />         WHEREAS, the City of Portsmouth has found it necessary to acquire the interests hereinaft ,r
<br /> specified in and to the hereinafter described parcel of land situate in the City of Ports-
<br /> mouth, Virginia, for the purpose of constructing, altering and widening Syer Road; and
<br />
<br />         WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br /> herein, necessary to the project, because of a defect in the title to the property in that
<br /> the present record owners of the property cannot be located; and
<br />
<br />          WHEREAS, advancement of the work and use of said project will be delayed unreasonably
<br /> if said property is not made available to the City as soon as possible.
<br />
<br />      NOW, TF£REFORE, BE IT RESOLVED by the Council~of the City of Portsmouth, Virginia,
<br /> that the City Attorney is directed to institute eminent domain proceedings against the follow-
<br /> ing described property situate in the City of Portsmouth, Virginia, for the purpose of acquir-
<br /> ing f~e simple title thereto, together with any and all easements of access, light or air
<br /> incident to the lands of the landowner abutting upon said property, in accordance with and
<br /> pursuant to Sections 2.06, 2.0? and 2.08 of the Charter of the City of Portsmouth (Chapter
<br /> 471 of the Acts of Assembly of 1970 as amended), and to deposit to the Clerk of the Circuit
<br /> Court of the City Of Portsmouth as provided by law the sum hereinafter specified to compensate
<br /> the owner of the parcel of land described as follows:

<br />         Beginning at a point on the northern right of way of Syer Street, Said point
<br />      being South 61°01'00'' West 100.1S feet from the northwestern intersection of
<br />      Syer Road with Syer Street; thence continuing along the northern right of way of
<br />      Syer Street South 61~01'00" WeSt 19.85 feet to a point on the eastern property
<br />      line of the property now or formerly o~med by the City of Portsmouth School Board;
<br />      ghence along the aforesaid City of Portsmouth School Board property line North
<br />      13°26'59" West 107.34 feet to a point; thence North 59~47'52" East 30.19 feet
<br />      to a point; thence South 8~24'13" East 111.15 feet to the point of beginning,
<br />      containing 0.59 acres.

<br />      The name of the property owner is Ketura Weirsdorf. The amount to be paid is $1,030.00."

<br />        Motion of Mr. Oast and seconded by Mr. Holley, that the City Manager furnish a report
<br />to Council whether or not a temporary easement for five year period can be granted for sign
<br />located on property of Dr, Donahue, was adopted by unanimous vote.
<br />
<br />       ~-469 - Mr. Charles Hladlk, 639 Dunedin Road, spoke as an individual regarding Halloween
<br />being left on Sunday.
<br />
<br />        76-470 - Mrs. Sylvia Wallace, 313 Maryland Avenue, spoke regarding Hallpween, stating
<br />that Port Norfolk observing it on Saturday, an'd recommended to be held on a day other than
<br />Sunday.
<br />
<br />        Motion of Mr. Holley and seconded by Mr. Barnes, wherever feasible urge our citizens to
<br />observe Halloween on Saturday, was defeated by the following vote:
