<br /> On motinn of Mr. Wentz and seconded by Mr. Elliott the following resolution was adope~d
<br />and by the following vote: '
<br />
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CFAPTER
<br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br /> THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF DEEP CREEK BOULEVARD.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter
<br />specified in and to the hereinafter described parcel of land situate in the City of Portsmout
<br />Virginia, for the purpose of constructing, altering and maintaining Deep Creek Boulevard.
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase property described herein
<br />necessary to the project, because the owners thereof in the City have not been able to agree
<br />upon price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonab]
<br />if said property is not made available as soon as possible.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. The City Attorney is directed to institute eminent domain proceedings against the
<br />following property situated in the City of Portsmouth, for the purpose of acquiring fee
<br />simple title therein, together with any and all easements of access, light or air incident
<br />to the lands of the landowner abutting upon said property, in accordance and pursuant to
<br />Sections 2.06, 2.0? and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the
<br />Acts of Assembly of 1970, as amended), and to deposit to the credit of ~he Clerk of the
<br />Circuit Court of the City of Portsmouth as provided by law the sum hereinafter stated to
<br />compensate the owners of the parcel of land designated on that certain plat entitled, "Plat
<br />of Deep Creek Boulevard Street Improvement, Des Moines Avenue to Wright Avenue", a copy
<br />of said plat is attached hereto.

<br />2. The name of the property owner is: Lennie W. Luke, Jr."

<br /> 76-456 "Consideration of a resolution authorizing the City Manager to enter into and
<br />sign an agreement with the Seaboard Coast Line Railroad Company £~r the purpose of trans-
<br />gressing certain railroad easements and rights-of-way.
<br />
<br /> This resolution is necessary in order to grant the City Manager the necessary authority
<br />to enter into the required agreements with the Seaboard Coastline Railroad in order to con-
<br />struct the Syer Road relocation project which is anticipated will be funded under the PuBlic
<br />Works Act."

<br /> On motionoof Mr. Wentz and seconded by Mr. Barnes, the following resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION AUTHORIZING THE CITY ~NAGER TO ENTER INTO AN AGREEMENT WITH
<br />THE SEABOARD COAST LINE RAILROAD COMPANY FOR THE PURPOSE OF OBTAINING AN
<br />EASEMENT FOR THE CONSTRUCTION, ALTERATION AND ~INTENANCE OF SYER ROAD.
<br />
<br /> WHEREAS, the City of Portsmouth desires to alter and extend Syer Road across a certain
<br />parcel of land owned by the Seaboard Coast Line Railroad Company; and
<br />
<br /> WHEREAS, the Seaboard Coast Line Railroad Company has agreed to permit the use of said
<br />property for the construction and maintenance of a street across said railroad property.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Manager be, and he hereby is, authorized to enter into an agreement with the
<br />Seaboard Coast Line Railroad Company for the purpose of obtaining an easement for the constru~
<br />tion, alteration end,maintenance of Syer Road."

<br /> 76-457 "Consideration of a resolution authorizing the School Board of the City of
<br />Portsmouth ~o apply for, receive, and expend funds not presently budgeted.
<br />
<br /> This resolution gives the School Board authorization to apply for Federal and State
<br />funds which may be available under categorical and block grants; and, to expend these funds
<br />at the discretion of the School Board. The City Manager recommends adoption."
<br />
