<br /> BE IT RESOLVED by the Council of

<br />the City of Portsmouth, Virginia, that the regular
<br />24, 1977 is changed to May 31, 1977 commencing at
<br />
<br />Ayes: Barnes, Barly, Blliott, Holley, Oast, Wentz, Davis
<br />Nays: None
<br />
<br /> 77-162 - "Consideration of a resolution to authorize the Virginia Port Authority to
<br />expend funds from surplus revenue for capital improvements at the Portsmouth Marine Terminal.
<br />
<br /> The Virginia Fort Authority by resolution has requested authorization by the Portsmouth
<br />City Council to expend funds for continued site development on the east waterfront tract in
<br />the amount of $50,000 from revenue earned by the PortsmOuth Marine Terminal. The Port
<br />Unification Agreement requires the Virginia Port Authority to obtain consent from the City
<br />Council before~aking such expenditures. The City Manager recommends adoption."

<br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was adopted
<br />and by the following vote:
<br />
<br />"A RESOLUTION TO AUTHORIZE THE VIRGINIA PORT AUTHORITY TO EXPEND FUNDS FROM
<br />SURPLUS REVENUES FOR CAPITAL IMPROVEMENTS AT THE PORTSMOUTH MARINE TE~{INAL.
<br />
<br /> WHEREAS, the
<br />Council to expend
<br />and
<br />
<br />Virginia Port Authority has requested authorization from Portsmouth City
<br />funds for certain capital improvements to the Portsmouth Marine Terminal;
<br />
<br /> WHEREAS, the Virginia Port Authority is required by the Port Unification Agreement
<br />to obtain consent from the City Council before making such expenditures; and
<br />
<br /> WHEREAS, the expenditures to be made will be funded from surplus revenue generated
<br />by the Portsmouth Marine Terminal; and
<br />
<br /> WHEREAS, the Fortsmouth City Council after duly considering the contemplated improvement~
<br />is of the opinion that such improvements are necessary and prudent investments.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that it approves the expenditure of Fifty Thousand ($50,000.)Dollars for continued site
<br />development on the East Waterfront Tract at Portsmouth Marine Terminal."

<br /> 77-i~63 - "Consideration of a motion authorizing the City Assessor to abate and the City
<br />Treasurer to refund with interest real estate taxes in the amount of $60.99.
<br />
<br /> This will authorize the refund of $33.84 for Map 797, Parcel 31, in Belvedere; and,
<br />$27.15 for Map 634, Parcel 56, on ~ypress Road. Copies of the requests made by the City
<br />Assessor's Office are attached for your information. The City Manager recommends adoption."
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Elliott, that authorization be granted, to
<br />refund with interest, real estate taxes in the amount of $60.99, was adopted by unanimous
<br />vote.
<br />
<br /> 77-164 - "Consideration of a motion appointing .Frederick B. Hill as the independent
<br />auditor for the City of Portsmouth.
<br />
<br /> A copy of the Municipal Finance~iiCom~ission's recommendation is attached for your infor-
<br />mation. The City Manager recommends' adoption.~
<br />
<br /> The following letter received from the Municipal Finance Commission:
<br />
<br /> "At its regular monthly meeting held April 19, 1977, the Municipal Finance Commission
<br />voted to recommend to the City Council that Frederick Bf Hill and Company, Certified Public
<br />Accountants, be selected as the City's independent auditor for 1977."
<br />
<br /> Motion of Mr. Holley and secondedbby Mr. Wentz, that Frederick B. Hill and Company,
<br />be appointed as the independent auditor, and was adopted by unanimous vote.
<br />
<br /> 77-165 - "In accordance with Section ll-6(b) of the City Code, I have transferred
<br />$20,000 from the budget contingency account for the purposes described below. The balance
<br />in said account subsequent to this transfer is $141,500.
<br />
<br /> The current budget provided $33,000 for the Police Professional Liability Insurance,
<br />which was the premiu~amount required for coverage by the Home Assurance Company. Home
<br />Assurance refused to renew the coverage and the only source which could be located is the
<br />Northeast Insurance Company. The Northeast premium is approximately $48,000 for limits of
<br />$~S0,000 per individual Bodily Injury, $S00,000 per incident B~dily Injury, and $S0,000
<br />Property Damage.
<br />
<br /> An amount of $5,000 was paid to the Natiomal Institute of Municipal Law Officers to
<br />participate in the funding of a lawsuit challenging the constitutionality of the Unemploy-
<br />ment Compensation Act of 1976. An attached letter from NIMLO provides additional informatio~
