June 22,1999 <br /> <br />- City Manager's Report - <br /> <br />99 - 142 - Adoption of an ordinance amending Section 12-250 of the Code of the City of <br />Portsmouth pertaining to withdrawal of a bid due to error. <br /> <br />This action is necessary to bring the City Code into compliance with Section <br />11-54 of the Virginia Code to take effect July 1, 1999. <br /> <br />Recommendation: <br /> <br />· Adoption of an ordinance amending Section 12-250 of the Code of the City of <br />Portsmouth pertaining to withdrawal of a bid due to error. <br /> <br />Purpose and Need: <br /> <br />· This revision will allow a bidder to withdraw his/her bid from consideration if it <br />can be clearly shown that the bid price is considerably lower than other bids due <br />to an unintentional clerical or arithmetic error or other unintentional omission in <br />the quantity of work used in the compilation of prices. <br /> <br />· This action is necessary to bring the City Code into compliance with Section <br />11-54 of the Virginia Code to take effect July 1, 1999. <br /> <br />Financial Impact: <br /> <br />· There is no financial impact for this item. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Robinett, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 12 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 12-250(a) THEREOF <br />PERTAINING TO WITHDRAWAL OF BID DUE TO ERROR." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst <br />Nays: None <br /> <br />99 - 143 - Adoption of a resolution authorizing the City Manager to execute an <br />amended agreement on behalf of the City of Portsmouth approving the definitive <br />merger agreement among the Peninsula Transportation District Commission, the <br />Tidewater Transportation District Commission, and the component governments <br />of the commissions. <br /> <br />Recommendation: <br /> <br />· Adoption of a resolution authorizing the City Manager to execute an amended <br />agreement on behalf of the City of Portsmouth approving the definitive merger <br />agreement among the Peninsula Transportation District Commission, the Tidewater <br />Transportation District Commission, and the component governments of the <br />commissions. <br /> <br />Purpose and Need: <br /> <br />· On March 23, 1999, the Portsmouth City Council authorized the City Manager to <br />execute the definitive merger agreement. <br /> <br />· After that approval, all six other participating jurisdictions authorized their City <br />Managers to execute the definitive agreement. However, two of the cities proposed <br />changes regarding dedicated revenues. First, all of the participating jurisdictions would <br />have to support the imposition or increase of a proposed tax to be used as dedicated <br />revenues for the Commission prior to seeking such authorization from the General <br />Assembly, and prior to the actual imposition or increase of such tax. Second, to the <br />extent permitted by law, any dedicated revenues authorized by the General Assembly <br />would be allocated to the city in which they were generated, unless the governing body <br />of that jurisdiction authorizes an alternative allocation. <br /> <br /> <br />
