June 22,1999 <br /> <br /> Whereas, in all his activities and endeavors he remained fiercely committed to <br />the improvement of all facets of life for his fellow citizens of the City of Portsmouth and <br />the Commonwealth of Virginia; and <br /> <br />Whereas, Dick Davis died on March 4, 1999 after a long, happy, and productive <br /> <br /> Now, Therefore, Be It Resolved by the Council of the City of Portsmouth, Virginia, <br />that the City of Portsmouth does hereby express its appreciation for the life of Richard <br />Joseph "Dick" Davis -leader, statesman, visionary, gentleman - and his many <br />contributions to the life of our City." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst <br />Nays: None <br /> <br />Presentation of a resolution to Lori Davis honoring Richard "Dick" Davis, former <br />Mayor of the City of Portsmouth. <br /> <br />- Unfinished Business - <br /> <br />Consent Aqenda <br /> <br />99 - 133 - Rezoning and use permit applications: <br /> <br /> Motion by Mr. Benn, and seconded by Mr. Robinett, to adopt the following <br />ordinance and resolution, and was adopted by the following vote: <br /> <br />99-133(a): <br /> <br />"ZONING AMENDMENT ORDINANCE Z-99-03." <br /> <br />99-133(b): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO VEHICLE RECYCLING <br />SOLUTIONS, INC., FOR THE OPERATION OF A MOTOR VEHICLE RECYCLING <br />FACILITY AT 3850 ELM AVENUE. <br /> <br /> WHEREAS, Vehicle Recycling Solutions, Inc., has made application pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988), for a use <br />permit to operate a motor vehicle recycling facility at 3850 Elm Avenue, Portsmouth, <br />Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility <br />with surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for <br />parking, driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> <br />
