This refund is for 1974-75 through <br />1976-77. The City Manager recomends adoption." <br /> <br /> Motion of Mr. Barnes and seconded by Mr. Oast, to concur in,the recommendation of the <br />City Manager, to refund $57.44 on property at 607 JeWell Av~nue,~w~iAh~interest, and was adopte,[~ <br />by unanimous vote. <br /> <br /> 77-258 - "Submission of a report from the City Manager advising the City Council of a <br />transfer of $78,000 from the Emergency Contingency Account to the City Garage Fund and the <br />Regional Group Home System. <br /> <br /> This report is forwarded in accordance with the City Code requiring the~3Cii~y Manager <br />.~to advise Council of any transfer from the ~mergency Contingency Account at the next regularly <br />scheduled Council meeting. Since $65,000 of this tranfer is between funds, a motion concur- <br />in§ in this transfer is requested." <br /> <br /> Report submitted: <br /> <br /> "The City Code requires in Sec. ll-6(b) that ~ransfers from the emergency contingency <br /> account be reported to the City Council at its next regular meeting. As of this date, I have <br /> transferred $78,000 from the emergency contingency fund, as fOllows: $63,000 to the City <br /> Garage Fund for the fleet liability insurance policey; and $15~000 to the Regional Group Home <br /> Commission. <br /> <br /> TAe $15,000 transfer to the Regional Group Home Commission is for advanced funding of the <br />Commission, and was made pursuant to the resolution adopted~by the City Council at its last <br />meeting. <br /> <br /> The $65,000 for auto liability insurance is necessary as a result of a fifty percent increase <br /> premium. As in other areas of liability coverage, the premium has increase~ at alarming rates~ <br /> and an increase of this magnitude was not anticipated in the ~976-77 budget~ A review of the <br /> causes for the premium increase is continuing to determine what cost-reducing actions might be <br /> taken. <br /> <br /> Subsequent to the above transfers, a balance of $65,500 remains in the emergency contin- <br />gency account, out of the original 1976-77 appropriation of $$20,000." <br /> <br /> Motion of Mr. Barmes and seconded by Mr. Early, that authorization be granted to transfer <br />$78,000 as requested, and was adopted by unanimous vote. <br /> <br /> 77-259 - "Consideration of a resolution authorizing Eminent Domain proceedings to be <br />brought for property in the Olde Towne Conservation and Redevelopment R~oject for the construc- <br />tion of parking lots. <br /> <br /> This quick-take condemnation is needed in order to proceed with~the construction of a pub] <br />parking lot under the Olde Towne Conservation Plan between Glasgow and North Streets contigu- <br />ous to Court,Street. After several months of effort, all of the legal owners have still not <br />been determined. Therefore in order not to further delay this project, we are seeking to con- <br />demn the property. The City Manager recommends adopt&on." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopted; <br />and by the following vote: <br /> <br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OE CERTAIN PROPERTY BY THE CITY <br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER <br /> 471 OE THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR THE <br /> CONSTRUCTION OF PARKING LOTS IN THE OLDE TOWNE CONSERVATION AND REDEVELOPMENT ~ <br /> PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafte~ <br />specified in and to the hereinafter described parcel of land situate in the City of Portsmouth <br />Virginia, for the purpose of constructing a parking lot in the Olde Towne Conservation And <br />Redevelopment Project. <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase all of the interest in <br />the property described herein, necessary to the project because of a defect in the title to th <br />property in that the present record owners of a portion of the interest in the property cannot <br />be located. <br /> <br /> WHEREAS, advancement of the work and use of said property will be delayed unreasonably <br />if this property is not made available to the City as soon as possible, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />in <br /> <br /> <br />
