July 13, 1999 <br /> <br />year while this Note is outstanding and unpaid, there shall be assessed, levied and <br />collected, at the same time and in the same manner as other taxes of the City are <br />assessed, levied and collected, a tax upon all taxable property within the City, over and <br />above all other taxes, authorized or limited by law and without limitation as to rate or <br />amount, sufficient to pay when due the principal of and interest on this Note if and to the <br />extent the revenues of the water and sewer system of the City are insufficient for that <br />purpose. <br /> <br />It is hereby certified, recited and declared that all acts, conditions and things required to <br />have happened, to exist and to be performed precedent to and in the issuance of this <br />Note and the issue of which it is a part have happened, do exist and have been <br />performed in due time, form and manner as required by law, and that the amount of this <br />Note, together with all other indebtedness of the City, does not exceed any limitation of <br />indebtedness prescribed by the Constitution or statutes of the Commonwealth of <br />Virginia or the Charter of the City. <br /> <br />IN WITNESS WHEREOF, the City has caused this Note to be executed by the manual <br />or facsimile signatures of its Mayor and Deputy City Manager for Finance; an <br />impression of the corporate seal of the City or a facsimile thereof to be affixed hereto or <br />imprinted hereon, and attested by the manual or facsimile signature of the City Clerk of <br />the City; and this Note to be dated August 15, 1999." <br /> <br />Ayes: <br />Nays: <br /> <br />Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />None <br /> - New Business - <br /> <br />99 - 158 - Mr. Griffin offered the following nomination for the following Boards and <br />Commissions: <br /> <br />TRANSPORTATION DISTRICT OF HAMPTON ROADS (FORMERLY TIDEWATER <br />TRANSPORTATION DISTRICT COMMISSION) <br /> <br />Councilman Cameron C. Pitts to be reappointed to fill a term with no expiration date <br />with Robert Creecy as the alternate. <br /> <br />Mayor James W. Holley, III to be reappointed to fill a term with no expiration date with <br />City Manager Ronald W. Massie as the alternate. <br /> <br /> Motion by Mr. Griffin, and seconded by Mr. Robinett, to close the nominations, <br />and there being no further nominations, the above nominations were adopted by <br />unanimous vote. <br /> <br />99 - 159 Items Submitted by City Council <br /> <br />Councilman Whitehurst read a statement he had prepared about the Washington <br />Park issue. <br /> <br />Adoption of resolution to support Congressman's Sisisky's efforts to permanently <br />relocate the residents of Washington Park and to have Washington Park <br />demolished. <br /> <br /> Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"A RESOLUTION IN SUPPORT OF THE EFFORTS OF UNITED STATES <br />CONGRESSMAN NORMAN SISISKY TO OBTAIN FEDERAL APPROVAL AND <br />FUNDING FOR THE PERMANENT RELOCATION OF ALL WASHINGTON PARK <br />RESIDENTS, DEMOLITION, AND REMEDIATION. <br /> <br /> WHEREAS, Washington Park is a public housing project constructed by the <br />Portsmouth Redevelopment and Housing Authority ("PRHA") pursuant to requirements <br />of the United States Department of Housing and Urban Development ("HUD") in <br />approximately 1964; and <br /> <br /> WHEREAS, in 1984 the United States Environmental Protection Agency ("EPA") <br />performed initial soil sampling and detected high levels of lead at and near the old Abex <br />lead foundry, which area EPA later declared to be a Superfund Site; and <br /> <br /> <br />
