315 <br /> <br />November 8, 1977 <br /> <br />At a regular meeting of the City Council held on November 8, 1977, there were present: <br /> <br />Richard J. Davis, Jack P. Barnes, E. Saunders Early, Jr., Archie Elliott, Jr., <br />James W. Holley, Edward L. Oast, Jr., Robert W. Wentz, Jr., R. T. Williams, <br />City Manager, Gordon B. Tayloe, Jr., City Attorney. <br /> <br /> The Rev. Robert N. Hoffman, Pastor, Trinity Episcopal Church, <br />prayer, followed by the Pledge of Allegiance to the Flag. <br /> <br />Mayor Davis welcomed all visitors in attendance. <br /> <br />opened the meeting with <br /> <br /> Motion of Mr. Wentz and seconded by Mr. Early, the minutes of the called meeting of <br />October 25, 1977; minutes of the regular meeting of October 25, 1977; minutes of the called <br />meeting of October 27, 1977, to be approved as received, was adopted by unanimous vote. <br /> <br />- UNFINISHED BUSINESS <br /> <br /> 77-393 - The following ordinance approved on first reading at the regular meeting of <br />October 25, 1977, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $20,000 FROM THE CAPITAl IMPROVEMENT FUND FOR <br />THE IMPROVEMENTS TO INDOOR FACILITIES AT VARIOUS SCHOOLS FOR RECREATIONAl <br />PURPOSES." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the ordinance was adopted, and by <br />the following vote: <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 77-394 - The following ordinance approved on first reading at the regular meeting of <br />October 25, 1977, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $55,000 FROM THE CITY GARAGE FUND FOR THE <br />PURCHASE OF A COMMERCIAL COLLECTION VEHICLE." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the ordinance was adopted, and by <br />the following vote: <br /> <br />Ayes: Barnes, Early, Elliott, Hotley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 77-395 - The following ordinance approved on first reading at the regular meeting of <br />October 25, 1977, was taken up and read: <br /> <br />"AN ORDINANCE TO APPROPRIATE $47,204 FROM THE MENTAL HEALTH SERVICE FUND FOR <br />THE OPERATION OF THE PORTSMOUTH LOCAL ALCOHOLISM SERVICE." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Early, the ordinance was adopted, <br />the following vote: <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast,~e~tz, .Da.~is <br /> Nays: None <br /> <br />and by <br /> <br /> 77-363 - The following ordinance, deferred from the meeting of September 27, 1977, was <br />taken up and read: <br /> <br />"AN ORDINANCE TO AMEND SECTIONS 9-21, <br />9-40 AND 9-41 OF THE CODE OF THE CITY <br />SECTION 9-24 THEREOF." <br /> <br />9-25, 9-26, 9-29, 9-30, 9-38, 9-39, <br />OF PORTSMOUTH, VIRGINIA, 1973; REPEALING <br /> <br />The City Attorney presented the following report: <br /> <br /> "On September 27, 1977 there appeared on the Council Agenda Item 77-363, an ordinance <br />to amend sections of the City Code pertaining to precinct boundary changes. <br /> <br /> You recall Ordinance No. 1976-144 was adopted on September 28, 1976 to meet the mandate <br />set forth in Chapter 376 of the 1976 General Acts of Assembly of the Commonwealth of Virginia~ <br />wherein it was stated that: '... precinct(s) shall be composed as nearly as practical of <br />contiguous and compact area having clearly defined and clearly observable boundaries.' <br /> <br /> Said Chapter 376 designated the State Division of Legislative Services to act as liaigon <br />between municipal corporations and the U. S. Census Bureau. <br /> <br /> After the adoption of Ordinance 1976-144 and subsequent to approval of said ordinance <br />by the U. S. Justice Department pursuant to the Civil Rights Act, the U. S. Census Bureau <br />rejected said election precinct boundaries as not meeting the criterion of the 'clea~y de- <br />fined and clearly observable boundaries.' <br /> <br /> As a result, representatives of the State Division of Legislative Services and the U. S. <br />Census Bureau came to Portsmouth and agreed upon election precinct boundaries which changes <br />appeared in proposed Ordinance Agenda No. 77-363. <br /> <br /> <br />
