OF PORTSMOUTH, VIRGINIA, 1973; REPEALING

The City Attorney presented the following report:

"On September 27, 1977 there appeared on the Council Agenda Item 77-363, an ordinance
to amend sections of the City Code pertaining to precinct boundary changes.

You recall Ordinance No. 1976-144 was adopted on September 28, 1976 to meet the mandate
set forth in Chapter 376 of the 1976 General Acts of Assembly of the Commonwealth of Virginia~
wherein it was stated that: '... precinct(s) shall be composed as nearly as practical of
contiguous and compact area having clearly defined and clearly observable boundaries.'

Said Chapter 376 designated the State Division of Legislative Services to act as liaigon
between municipal corporations and the U. S. Census Bureau.

After the adoption of Ordinance 1976-144 and subsequent to approval of said ordinance
by the U. S. Justice Department pursuant to the Civil Rights Act, the U. S. Census Bureau
rejected said election precinct boundaries as not meeting the criterion of the 'clea~y de-
fined and clearly observable boundaries.'

As a result, representatives of the State Division of Legislative Services and the U. S.
Census Bureau came to Portsmouth and agreed upon election precinct boundaries which changes
appeared in proposed Ordinance Agenda No. 77-363.
