<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia;

<br /> That the City Attorney be directed to institute eminent domain proceedings against the
<br />following property situate in the City of Portsmouth for the purpose of acquiring fee simple
<br />title therein, together with any and all easements of access, light or air, incident to the
<br />lands of the landowner abutting upon said property, in accordance with and pursuant to Section
<br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assem
<br />1970, as amended), a~d to deposit to the credit of the Clerk of the Circuit Court of the City
<br />of Portsmouth as provided by law the sum herein specified to compensate the owners of the
<br />parcel of land known, numbered and designated as Lot 231 on the Plat of Pinners Point Waterfro
<br />Land Company recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake,
<br />Virginia, reference to said plat being made for a more particular description of the property.

<br /> WHEREAS, by easement agreement dated October 27, 1970, Amelia G. McLean and George T.
<br />McLean, her husband, conveyed to the City of Portsmouth an easement agreement under and across
<br />the following described property, to-wit:

<br /> Beginning at a point on the northwest corner of Yorkshire Road and
<br /> Elmhurst Lane; thence N05°31'12'' ease along the western right-of-way
<br /> of Elmhurst Lane extended a distance of 1,585.42 feet to the true point
<br /> of beginning; thence N84°28'48'' west 137.75 feet t~ a point on the rear
<br /> property line of Manor View, Section 2; thence NOSV31'12'' east 15 feet
<br /> to a point; thence S84!28'48" east 137.75 feet to a point on the western
<br /> right-of-way of Elmhurst Lane extended; thence S05°31'12'' west 15.00 feet
<br /> along said right-of-way to the True Point of Beginning.

<br /> WHEREAS, the fee simple owners of the property on which said easement was granted have
<br />caused said property to be subdivided into lots; and

<br /> WHEREAS, due to the configuration of said subdivision lots, it is necessary to relocate
<br />the previously granted easement; and
<br />
<br /> I~EREAS, the subdivision plat to be recorded bY the property owners describes a new easem,
<br /> to be dedicated to the City for installation and maintenance of drainage pipes and lines, and
<br /> the same has been approved by the Engineering Department.
