S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT <br /> REGIONAL OFFICE AS ADMINISTRATIVE SUPPORT FOR THE FEDERAL REGIONAL COUNCIL." <br /> <br /> 78-9 "Consideration of an ordinance on first reading to appropriate $12,200 from the <br />Anti-recession Fiscal Assistance Fund for the City's share of the Staff Assistant Internship. <br /> <br /> This is a companion ordinance to the ordinance previously presented that provides the <br />necessary funds from the Anti-resession Fiscal Assistance monies to cover the City's share <br />of the internship. The City Manager recommends adoption on first reading." <br /> <br /> On motion of Mr. Elliott and seconded by Mr. Oast, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE S12,200 FROM THE ANTI-RECESSION FISCAL <br />ASSISTANCE FUND FOR THE CITY'S SHARE OF A STAFF ASSISTANCE INTERNSHIP <br />SPONSORED BY THE U. S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT REGIONAL <br />OFFICE AS ADMINISTRATIVE SUPPORT FOR THE FEDERAL REGIONAL COUNCIL." <br /> <br /> 78-10 "Consideration of an ordinance to amend the Classification and Pay Plan ordinanc <br />#1977-61 to reflect changes in the Federal Minimum Wage Requirement. <br /> <br /> This ordinance will establish paragraph ~ section 4 which permits ingrade increases <br />to reflect changes in Federal Minimum Wage. This amendment is being made to reflect the <br />City's voluntary commitment to pay minimum wage as set forth by the Federal guidelines. <br />Except for personnel employed under the Federal programs the local cost will be less than <br />$10,000 for the six month period. The cost will be absorbed by the existing budgets. The <br />City Manager recommends adoption." <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND SECTION 3(c) <br />AND PAY PLAN, ORDINANCE NO. 1977-61 <br />MINIMUM WAGE." <br /> <br />OF THE CITY OF PORTSMOUTH'S CLASSIFICATION <br />BY REFLECTING THEREIN, CHANGES IN THE FEDERAL <br /> <br /> Ayes: Early, Elliott, Holley, Oast, Davis <br /> Nays: None <br /> <br /> 78-11 "Consideration of an ordinance to amend the City Code to authorize the City <br />Manager to tr'ansfer up to $10,000 within the same accounting fund, from one department to <br />another department, project, program, or purpose. <br /> <br /> The current ordinance permits the transfer of any unencumbered balance, not to exceed <br />$10,000 from one department to another. However, this does not permit the transfer of funds <br />for projects or programs that have unencumbered appropriated ~Rlances. This amendment will <br />permit the transfer of up to $10,000 within a fund for department, project, or program. The <br />City Manager recommends adoption." <br /> <br /> On motion of Mr. Early and seConded by Mr. Elliott, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />AS AMENDED, BY AMENDING SECTION 11-6 THEREOF; PERTAINING TO TRANSFERS OF <br />APPROPRIATIONS." <br /> <br />Ayes: Early, Blliott, Holley, Oast, Davis <br />Nays: None <br /> <br /> 78-12 "Consideration of an ordinance to amend the City Code of the City of Portsmouth <br />pertaining to definitions in the Utility Service Tax. <br /> <br /> This amendment redefines the definitions applicable to the Utility Service Tax by ex- <br />plicitely including "purchaser" as any actual user of a public utility service and does not <br />limit such user to the person who is billed or pays directly for the utility service. The <br />Supreme Court of Virginia recently rules that the unamended ordinance did not define purchaser <br />to include as residential users the tenants of single family units when said unit is part <br />of a residential complex in which one or more residential unit is served by one meter (Master <br />Meter). The adoption of this amendmeJt will permit the uniform application of the Utility <br /> Tax to all residential~units. .The City Manage? recommends adoption." <br /> <br /> On motion of Mr. Oast and seconded by Mr. Ea~y, the following ordinance was approved on <br />first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO AMEND ARTICLE VII OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />BY AMENDING SECTIONS 35-133, 33-114, 35-122, PERTAINING TO UTILITY SERVICES TAX." <br /> <br /> <br />
