<br /> All that certain piece or parcel of land, situate, lying and being in
<br />the City of Portsmouth, Virginia, more particularly bounded and described
<br />as follows:

<br />Beginning at a point on the southern right of way of Portsmouth Boulevard,
<br />said point being S 779 ~9' 00" east 370.00' from the southeast intersection
<br />of Portsmouth Boulevard and Manor Road; thence from said point of beginning,
<br />S 12° 21' OO" west 50.00' to a point; thence S 217 09' O0" east 320.80' to
<br />a point; thence N 68~ 51' 00" east 47.75' to a point; thence S 77v 36' 00"
<br />east 7.39' to a point; thence N 21° 09' OO" west 399.16' to a point on the
<br />southern right of way of Portsmouth Boulevard; thence along the southern
<br />right of way of Portsmouth Boulevard N 77939' O0" west 31.55' to the Point
<br />of Beginning.

<br />Said parcel being shown on that certain plat entitled: "Plat Showing Surplus
<br />Property Of The City Of Portsmouth Known As The Duck Pond", dated December
<br />30, 1977, prepared by the Engineering and Technical Services Department of
<br />the City of Portsmouth, Virginia, said plat being attached hereto.
<br />
<br /> WHEREAS, said land is no longer needed by the City of Portsmouth and is, therefore,
<br />declared to be surplus property.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Manager be, and he hereby is, authorized to advertise and receive
<br />bids for the sale of the hereinabove described property subject to a minimum bid restriction
<br />of Fifteen Hundred ($1,500.) Dollars and such other terms and conditions as he may
<br />deem proper."

<br />
<br /> 78-33 - "Consideration of a resolution appointing viewers for the closing of a portion
<br />of Nelson Street, Fayette Street, Edwards Street, Pembroke Avenue, Cutherell Street,
<br />McKinley Street, Whitson Street, County Street, Belle Street, Hickory Street, Railroad
<br />Avenue, Van Dyke Street, Romanesque Street and Phillips Avenue.
<br />
<br /> The Portsmouth Redevelopment and Housing Authority has made application to vacate
<br />and close portions of the above streets. The City Planning Commission has approved same
<br />and thiszresolution will appoint viewers pursuant to State law. TheCCity Manager recom-
<br />mends adoption."
<br />
<br /> On motion of Mr. Barnes and seconded by Mr. Early, the following resolution was adopted,
<br />and by the following vote:

<br /> "A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREETS:
<br /> PARCEL I - A PORTION OF NELSON STREET, PARCEL II - A PORTION OF FAYETTE
<br /> STREET PARCEL III - A PORTION OF EDWARDS STREET, PARCEL IV - A PORTION
<br /> OF PEMBROKE AVENUE, PARCEL V - A PORTION OF CUTHERELL STREET, PARCEL VI
<br /> A PORTION OF McKINLEY STREET, PARCEL VII - A PORTION OF ~ITSON STREET,
<br /> PARCEL VIII - A PORTION OF COUNTY STREET, PARCEL IX - A PORTION OF BELLE
<br /> STREET, PARCEL X - A PORTION OF HICKORY STREET, PARCEL XI - A PORTION
<br /> OF RAILROAD AVENUE, PARCEL XII - A PORTION OF VAN DYKE STREET, PARCEL
<br /> XIII -A PORTION OF ROmaNESQUE STREET AND PARCEL XIV - A PORTION OF
<br /> PHILLIPS AVENUE.

<br /> WHEREAS, the Portsmouth Redevelopment And Housing Authority has made application
<br />to vacate~ Close and discontinue the hereinafter described portion of certain streets,
<br />and it appearing that Notice of Application and request for the Appointment of Viewers
<br />was duly posted January 11, 1978 on the bulletin board of the General District Court,
<br />Civil Division, of the City of Portsmouth and the bulletin board of the Circuit Court
<br />of the City of Portsmouth
<br />
<br /> NOW, THEREFORE, BElT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that Frank N. Bilisoly, H. L. Davis, C. E. Ellis, Linon Vann, A, N. Kendrick and L.
<br />A. Clark be appointed an alternate viewer in the event one of'the preceding Viewers
<br />fail to participate, said viewers to view the hereinafter described portion of such
<br />streets and to report to this Council in writing whether in their opinion any, and if
<br />any, what inconvenience would result in vacating and closing the following:

<br />NELSON STREET
<br />
<br /> All that certain piece or parcel of land, lying and being in the City of
<br />Portsmouth, Virginia, and comprising that portion of Nelson Street lying be-
<br />tween Seventh Street and Washington Street.

<br />FAYETTE STREET
<br />
<br />':.All that certain piece or parcel of land, lying and being in the City of
<br />POrtsmouth, Virginia, and comprising that portion of Fayette Street lying
<br />between Seventh Street and Washington Street.

<br /> Ail that certain piece or parcel of land, lying and being in the City of
