<br />its regular monthly meeting of March 8, 1978, the Planning Commiss~ion met with
<br />Norman Whitlow and the abort named applicant, After a lengthly discussion, the
<br />Commission unanimously resolved to reaffirm its position regarding denial of
<br />
<br /> The following letter from Morton V. Whitlow, Attorney, for the petitioner was received:
<br /> "Re: Zoning Petition of Lucille Griffin and Susan Vincent
<br />
<br /> On behalf of my clients, Lucille Grfffin and Susan Vincent, I would like to ask the
<br />City Council of the City of Portsmouth to allow my clients to withdraw their petition as
<br />above referenced as to the rezoning of the subject property.
<br />
<br /> I will not be appearing at the City Council meeting on March 14 concerning this matter
<br />and I would appreciate very much your bringing my request to the attention of the Council
<br />when this matter come before it for consideration."
<br />
<br /> Motion of Mr. Ba~n~sand seconded by Mr. Wentz, to concur in the recommendation of the
<br />Planning Commission, the petition was denied, and by the following vote:

<br /> 78-12 The following ordinance approved on first reading at the regular meeting of
<br />January 10, 1978, was presented:

<br /> "AN ORDINANCE TO AMEND ARTICLE VII OF THE CODE OF THE CITY OF PORTSMOUTH,
<br /> VIRGINIA, BY AMENDING SECTIONS 35-133, 35-114, 35-122, PERTAINING TO UTILITY
<br /> SERVICES TAX."

<br /> Motion of Mr. Wentz and seconded by Mr. Elliott, that the ordinance to be adopted.

<br /> Motion of Mr. Barnes and seconded by Mr. Wentz, the ordinance to be amended, and was
<br />adopted by unanimous vote.

<br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following ordinance as amended,
<br />was adopted, and by the following vote:

<br />"AN ORDINANCE TO AMEND SECTION.SS-Ii4 AND SECTION 35-122 OF_THE CODE OF THE CITY
<br />FORTSMOUTH,_1973, AS ~E~D~E~, PERTAINING TO UTILITY SERVICES TAX. '

<br />~ "You will recall that on January 10, 1978, a Public Hearing was held on Agenda Item
<br />78-12 which was a proposed amendment to the Utility Services Tax pertaining to electric and
<br />gas service by Master Meters to residential multi-family apartment complexes. After such hear
<br />· ng, the proposed ordinance was adopted with the stipulation that the City Manager and the
<br />City Attorney meet with those parties which had litigated the Utility Services Tax in the
<br />Supreme Court of Virginia.

<br /> A meeting was held on January 17, 1978 in which a new approach to the Utility Services
<br />Tax was proposed. Following such meeting a new ordinance was proposed and circulated to
<br />the persons concerned with the litigatian. I am happy to report that the enclosed proposed
<br />ordinance, Agenda Item 78-12, is unopposed by the parties to the aforementioned litigation."
<br />
<br /> The following reports from the City Manager were presented:
<br />
<br /> 78-85 "Consideration of an ordinance on first reading to appropriate $131,111 from the
<br />Grants Fund to renovate the City Jail in order to provide space for programs.
<br />
<br /> This appropriation will provide funds necessary to initiate a renovation program at the
<br />City Jail which will have as its objectives: relocation and expansion of existing adminis-
<br />trative effice areas, development of an efficient intake service center in the basement, relo-
<br />cation and expansion of medical spaces from the second floor to the basement, development of
<br />space and facilities for inmate physical activities; and, sufficient program space for inmate
<br />utilization. The City Manager recommends adoption on first reading."
<br />
<br /> On motion of Mr. Early and seconded by Mr. Barnes, the following ordinance was approved
<br />on first reading, and by unanimous vote:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $131,111 FROM THE GRANTS FUND FOR RENOVATION OF
<br />THE CITY JAIL IN ORDER TO PROVIDE SPACE FOR PROGRAMS."
<br />
<br /> 78-86 - "Consideration of an ordinance on first reading to appropriate $1,115,700 from
<br />the Capital Improvements Fund for progress payments to the Virginia Department of Highways
<br />and Transportation for the new Western Freewa-y Bridge and approaches.
