389 <br /> <br />March 28~ 1978 <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO CONVEY CERTAIN CITY-OWNED <br />PROPERTY, 915 QUEEN STREET. <br /> <br /> WHEREAS, by resolution adopted by the Council of the City of Portsmouth, Virginia, <br />on February 28, 1978, the City Manager did advertise and receive bids for the sale of certain <br />City-owned property known as 915 Queen Street; and <br /> <br /> WHEREAS, the offer of William R. Davis to exchange property located at 329 Fayette <br />Street for the hereinafter described City-owned property was received and is hereby accepted. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized to convey to William R. Davis the <br />hereinafter described property known as 915 Queen Street, Portsmouth, Virginia: <br /> <br /> All that certain lot, piece or parcel of land, with the improvements <br />thereon, situate on the south side of Queen Street, Portsmouth, Virginia, <br />bounded and described as follows: <br /> <br />Beginning at a point distant 188' west from the southwest intersection of <br />Queen street and Chestnut Street; thence running south and parallel with <br />Chestnut Street 1OO' to Wall Street; thence west along the north side of <br />Wall Street 50'; thence north and parallel with Chestnut Street 100' to <br />Queen Street; thence east along Queen Street 50' to the Point of Beginning. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute <br />all documents in connection with the conveyance of said property." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz <br />Nays: None <br /> <br /> 78-107 "Consideration of a resolution urging the adoption and funding by the Congress <br />of the United States of a program of payments to local governments in lieu of property taxes <br />on property owned by the Federal Government. <br /> <br /> Public Law 94-565 has been adopted by the Congress of the United States and has been <br />funded in the amount of $100,000,000 for payments to certmin counties in lieu of taxes on <br />Federally owned real property. Also House Resolution 951 was introduced in the U. S. Congress <br />to provide for~payments in lieu of real property taxes for local governmental units. The <br />U. S. Conference of Mayor has resolved to pursue the enactment of a~program of payments in <br />lieu of taxes for cities and urban governments. This resolution is requesting the Congress <br />of the United States to adppt and fund a program of payments to local governments in lieu <br />of property taxes on property owned by the Federal Government. The City Manager recommends <br />adoption." <br /> <br /> on motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopte¢ <br />and by the following vote: <br /> <br /> ?'A RESOLUTION URGING THE ADOPTION AND FUNDING BY THE CONGRESS OF THE UNITED <br /> STATES OF A PROGRAM OF PAYMENTS TO LOCAL GOVERNMENTS IN LIEU OF PROPERTY TAXES <br /> ON PROPERTY OWNED BY THE EEDERAL GOVERNMENT. <br /> <br /> WHEREAS, local governments are often deprived of substantial revenues which would <br />be collectable if property owned by the Federal Government were subject to tax as private <br />property; aa~d <br /> <br /> WHEREAS, the location of property owned by the Pederal Government places continued <br />on local government for urban services without commensurate return to the local government; <br />and <br /> <br /> WHEREAS, the impact of a substantial amount of Federal property within the boundaries <br />of local government jurisdiction creates an immense burden on the remaining tax base to suppo~ <br />the services required by private and federal property; and <br /> <br /> WHEREAS, HR-931 was introduced in the U. S. Congress to provide for payments in lieu <br />of real property taxes for lOcal governmental units; and <br /> <br /> WHEREAS, PL-94-565 has been adopted by the Congress of the United States and has been <br />funded in the amount of One Hundred Million ($100,OO0,OOO.) Dollars for payments to certain <br />counties in lieu of taxes on Federally-owned real property; and <br /> <br /> WHEREAS, the U. S. Conference of Mayors has resolved to pursue the enactment of a t <br />of payments in lieu of taxes for cities and urban governments; and <br /> <br /> WHEREAS, the impact of Federal property amounts to a reduction in the real estate tax <br />base by thirty-eight percent (38%) in the City of Portsmouth, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the Congress of the United States is urged to adopt and fund a program of payments to local <br />governments in lieu of property taxes on property owned by the Federal Government. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk be, and she hereby is, directed to forWard <br />a certified copy of this resolution to Senator Harry F. Byrd, Jr., Senator William B. Scott, <br />Jr., Congressman Robert W. Daniel and the U. S. Conference of Mayors." <br /> <br /> <br />
