<br /> "A RESOLUTION TO:PROVIDE EOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br /> OE PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER
<br /> 471 OF THE~ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br /> THE CONSTRUCTION AND IMPROVEMENTS OF PORT FACILITIES.
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the hereinafter
<br /> described interest in and to the hereinafter described parcel of land situate in the
<br /> City of Portsmouth, Virginia, for the purpose of construction and improvement of port faciliti
<br /> and
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />-herein, necessary to the project, because the owners thereOf and the City have not been
<br />able to agree upon the price to be paid therefor; and
<br />
<br /> WHEREAS, the advancement of the work and use of said project will be delayed unreasonably
<br /> if said property is not made available as soon as possible.
<br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia;
<br /> that the City AttOrney be, and he hereby is, directed to institute eminent domain proceedings
<br /> against' the follOWing property situate in the City of Portsmouth, Virginia, for the PUrpose
<br /> of acquiring fee simple title therein, together with any and all easements of access, light
<br /> or air incident to the lands of the landowner abutting upon said preperty, in accordance
<br /> with and pursuant to Section 2.06, 2,0? and 2.08 of the Charter of the City of Portsmouth,
<br /> (Chapter 471 of the Acts of Assembly of 1970, as amended), and to deposit to the credit
<br /> of the Clerk of the Circuit Court of the City of PortsmOuth as provided by law the sum herein-
<br /> after specified to compensate the owners of the parcel of land known as 104 Pinners Avenue,
<br /> Lots 115 and 114 on the Plat of Pinners Point Waterfront Company,.recorded in the Clerk's
<br /> Office of the circuit Court of the City of Chesapeake, Virginia, in MaP Book 4, page 52.

<br /> 78-171 -'Eonsideration of a resolution to provide for the acquisition of certain property
<br />by the City of Portsmouth under Eminent Domain proceedings.
<br />
<br /> Said property being necessary for the construction of improvements at the port facility.
<br />This resolution and the one above are necessary for the City Attorney to commence condemnation
<br />proceedings because the owner of said property has refused consideration for the purchase
<br />of same. The consideration offered by the City of Portsmouth resulted from independent
<br />appraisals of the fair market value. The City Manager recommends adoption."

<br /> On motion ofMr. Oast and seconded by Mr. Blliott, the following resolution was adopted,

<br /> to Section 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, (Chapter 471 of the
