June 2~7, 1978 <br /> <br />At a regular meeting of the City Council, held on June 27, 1978, there were present: <br /> <br />Jack P. Barnes, E. Saunders Early, Jr., Archie Elliott, Jr., James W. Holley, <br />Edward L. east, Jr., Robert T. Williams, City Manager, Gordon B. Tayloe, Jr., <br />City Attorney. <br /> <br />Absent: Richard J. Davis, Robert W. Wentz, Jr. <br /> <br /> Rev. T. M. Frye, Pastor, Biltmore Baptist Church, opened the meeting with prayer, followe <br />by the Pledge of Allegiance to the Flag. <br /> <br /> Ci.ty Attorney Gordon B. Tavloe, Jr., City Attorney, presided over the meeting until a <br />mayor pro tempore was elected. <br /> <br /> Motion of Mr. Early and. seconded by Mr. Elliott, the minutes of the Public Hearing meetin <br />of June 12, 1978; minutes of the regular meeting of June 13, 1978, to be approved as received, <br />was adopted by unanimous vote. <br /> <br /> 78~201 --Motion of Mr. Oast and seconded by Mr. Early, that Couucilman <br />ed to serve as mayor pro tempore in the absence o£ the mayor and vice-mayor, <br />by unanimous vote. <br /> <br />Barnes to be elect <br />and was adopted <br /> <br />Mr. Barnes then chaired the meeting and welcomed all visitors in attendance. <br /> <br />UNFINISHED BUSINESS - <br /> <br /> 78-180 The following ordinance approved on first reading at the Public Hearing meeting <br />of June 12, 1978, was taken up and read: <br /> <br />(d) ['ZONING AMENDMENT ORDINANCE Z 78-12" <br /> <br /> On motion of Mr. Early and seconded by Mr. Holley, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: Barnes, Early, Etliott, Holley, east <br />Nays: None <br /> <br /> 78-180 - The following ordinance approved on first reading at the Public Hearing meeting <br />of June 12, 1978, was taken up and read: <br /> <br />(e) "ZONING AMENDMENT ORDINANCE Z 78-13" <br /> <br /> On motion of Mr. east and seconded by Mr. Elliott, the ordinance was adopted, and by the <br />following vote: <br /> <br />Ayes: B-arnes, Early, Elliott, Holley, east <br />Nays: None <br /> <br /> 78-180 - On motion of Mr. Early and seconded by Mr. east, the following resolution <br />approved on first reading at the Public Hearing meeting of June 12, 1978, was adopted and <br />the following vote: <br /> <br />by <br /> <br />(f) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO ELIZABETH THORNTON TO OPERATE A <br />GROUP RESIDENCE ON TURNPIKE ROAD. <br /> <br /> WHHREAS, James H. Coppedge, on behalf of a contract owner, <br />an application pursuant to Section 40-71(b) of the Code of the <br />for the granting of a use permit as hereinafter described; and <br /> <br />Elizabeth Thornton, made <br />City of Portsmouth, 1973, <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to <br />be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of said use p~rmit. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br />(1) That t~e-use:fer-whick the use permit hereinafter described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing and <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to property improvements <br />in the neighborhood; and <br /> <br />(c) Will be in accord with the purposes of the Zoning Chapter of the City Code. <br /> <br />(2) That Elizabeth Thornton is hereby granted a use permit pursuant to Section 40- <br />71(b) of the Code of the City of Portsmouth, 1973, to operate a group residence on property <br />described hereafter subject to the conditions set forth in paragraph (3) of this ordinance. <br /> <br /> Beginning on the north side of Turnpike Road approximately 125 feet <br />west from its intersection with Romanesque Street; thence northerly 1OO feet <br />to a rear property line; thence westerly 150 feet to a point; thence southerly <br />1OO feet to the north right-of-way line of Turnpike Road; thence easterly along <br />said right-of-way 150 feet to the point of origin. <br /> <br /> <br />
