AN ORDINANCE TO ~2~END THE CODE OF TIiE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AMENDING SECTION 40-31 OF SAID CODE PERTAINING TO DEFINITIONS. <br /> <br /> ~E IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Seotion 40-31 of the Code of the City of <br />Portsmouth, Virginia, 1973 be amended and reordained to read <br />as follows: <br /> <br />Section 40-31. Definitions. <br /> <br /> Unless otherwise expressly stated, the following words <br />shall for the purpose of this chapter have the meanings herein <br />indicated. Words used in the present tense include the future. <br />The singular number includes the plural and the plural the <br />singular. The word "shall" is mandatory, not directory. <br /> <br /> Automobile repair garage. Any building or part thereof <br />wherein is kept or stored a motor vehicle or wherein painting, <br />body and fender work, engzne overhauling or other major repair <br />of motor vehicles is performed. This occupancy shall not include <br />automotive service stations as defined herein. <br /> <br /> Automotive service stations. A place of retail business <br />at which outdoor automotive refueling is carried on using fixed <br />dispensing equipment connected to underground storage tanks by <br />a closed system of piping, and at which goods and. services gen- <br />erally required in the operation and maintenance of motor vehicles <br />and the fulfilling of motorist needs may also be available. The <br />building may consist of a sales office where automotive accessories <br />and packaged automotive supplies may be kept or displayed. It may <br />also include one or more service bays in which vehicle washing, <br />lubrication and minor replacement, adjustment and repair services <br />are rendered. Such use shall not include the outdoor storage of <br />self-propelled motor vehicles, whether operative or inoperative. <br /> <br /> Billboard. Any notice or advertisement, pictorial or <br />otherwise, with an area of two hundred seventy-five (275) or <br />more square feet, and, without reqard to area, all those used <br />as an outdoor display for the purpose of making anything kno~, <br />the origin or place of sale of which is not on the plot with <br />such display~ except that governmental notices shall not be <br />considered to be billboards. (See definition of "sign.F) <br /> <br /> Building. Any structure enclosed and isolated by exterior <br />walls constructed or used for residence~ business, industry or <br />other public or private purposes, or accessory thereto, and in- <br />cluding tents, trailers, free-standing billboards and signs, fences, <br /> <br /> <br />
