Sec. 22-636. Violation of parking regulations. <br />It shall be unlawful for any person to violate any regulation relating to parking in off- <br />street lots or in garages designated in or pursuant to section 22-631. <br />Sec. 22-637. Procedure in case of violation. <br />(a) It shall be the duty of each police officer, or uniformed city employee or appointee <br />whose normal duties include parking enforcement, acting in accordance with <br />instructions issued by the chief of police, to report: <br />(1) The number of each parking meter, if any, that indicated that a vehicle <br />occupying the parking space adjacent to such parking meter is or has been <br />parked in violation of any of the provisions of this division, or other <br />information indicating a payment violation and the location of the violation. <br />(2) The state license number and/or any other identifying information of such <br />vehicle. <br />(3) The length of time during which such vehicle is parked in violation of any of <br />the provisions of this division. <br />(4) Any other facts, knowledge of which is necessary to a thorough <br />understanding of the circumstances attending such violation. <br />(b) Each police officer or other uniformed City employee or appointee whose normal <br />duties include parking enforcement, shall attach to the vehicle a notice to the owner <br />thereof; that the vehicle has been parked in violation of a provision of this division <br />and instructing the owner to pay the penalty or state objection to and intent to contest <br />the notice of violation. Each owner may, within 14 days of the time when such notice <br />was attached to the vehicle, pay a penalty in the sum of $25.00 for violation of any of <br />the provisions of this division. An owner may state objection to and intent to contest <br />a violation notice by filing a request for a hearing with the Portsmouth General District <br />Court Traffic Division within 14 calendar days of the date of the violation notice. If <br />the owner of the vehicle fails to make the payment within 14 days of the time when <br />such notice was attached to the vehicle or state objection to and intent to contest the <br />notice of violation, then an additional notice shall be given the owner, and an <br />additional penalty of $10.00 shall be charged for the additional notice. All monies <br />shall be paid to the city treasurer, who shall be accountable therefor. <br />Sec. 22-638. Prima facie guilt of owner of vehicle. <br />The owner of any vehicle parked in violation of this division shall be prima facie <br />guilty of such violation. <br />Sec. 22-639. Removal, storage of vehicles unlawfully parked. <br />(a) The city or the parking authority may cause any motor or other vehicle, occupying, <br />without permission or in violation of this division or division 2 (Pay Parking Zones) <br />or any regulation of the parking authority, any pay parking zone space, off-street <br />parking lot, or garage, to be removed by the police department and to be placed in <br />such storage facility as may be designated by the city manager. <br />
