UP -25-17 <br />1607 Prentis Avenue <br />(Tax Parcel 0069-0530) <br />ALL THAT certain tract, piece or parcel of land shown as Lot 414A on <br />that certain plat titled "Minor Subdivision of Lots 412 & 414 Prentis <br />Place (M.B. 3, P. 65 Chesapeake) Disposition Parcels 41 & 42 Prentis <br />Park Conservation Project", prepared by DKT Associates, dated <br />November 14, 2023, and recorded in the Clerk's Office of the Circuit <br />Court for the City of Portsmouth, Virginia in Map Book 26 at Page 238. <br />IT BEING that certain property conveyed to Curtis Nesbitt by Special <br />Commissioner's Deed from Derek G. Challenger, Esq. dated December <br />21, 2022 and recorded in the Clerk's Office of the Circuit Court for the <br />City of Portsmouth, Virginia as Instrument Number 202216270. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the concept plan <br />entitled "Use Permit Drawing — 1607 Prentis Avenue — Survey" prepared <br />by VBCADCO dated January 22, 2026 and the rendered concept elevations <br />titled "Use Permit Drawing — 1607 Prentis Avenue" prepared by <br />VBCADCO dated January 22, 2026, except where modifications may be <br />required to comply with all applicable local, state, and federal codes and <br />regulations, including City Code Chapter 14.1 (Flood Protection). <br />(b) The development shall not include more than three (3) townhouses. <br />(c) Before Site Plan Review approval, a Minor Subdivision plat to subdivide <br />the subject property into three (3) parcels for townhouses and complying <br />with Chapter 33.1 of the City Code (Subdivisions) must be submitted to and <br />approved by the City and recorded in the land records. <br />(d) The developer shall submit a site plan for review and approval and shall <br />also comply with Chapter 11.1 of the City Code (Erosion and Stormwater <br />Management). The development will be reviewed by the City for <br />compliance with all applicable local, state, and federal codes and <br />regulations. <br />(e) Without limitation, this Use Permit is subject to Section 40.2-533(K) of the <br />Zoning Ordinance, which provides that this Use Permit may automatically <br />expire and become void if certain conditions set forth therein are not <br />satisfied within two (2) years of the date of approval by City Council. <br />
