ORDINANCE NO. 2025-104 <br />AN ORDINANCE ACCEPTING A DAM SAFETY, FLOOD PREVENTION AND <br />PROTECTION ASSISTANCE FUND GRANT IN THE AMOUNT OF $334,117.76 <br />FROM THE VIRGINIA DEPARTMENT OF CONSERVATION AND <br />RECREATION AND APPROPRIATING SAID AMOUNT IN THE DAM <br />UPGRADES PROJECT IN THE WATER CATEGORY OF THE FY 2026 <br />CAPITAL IMPROVEMENT FUND BUDGET FOR THE PRELIMINARY <br />ENGINEERING REPORT NECESSARY TO EVALUATE THE SPILLWAY AT <br />LAKE KILBY DAM. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That it hereby accepts a Dam Safety, Flood Prevention and Protection <br />Assistance Fund grant in the amount of $334,117.76 from the Virginia Department of <br />Conservation and Recreation and appropriates said amount in the Dam Upgrades Project <br />in the Water Category of the FY 2026 Capital Improvement Fund Budget. <br />2. That the funds shall be used for the geotechnical investigation and/or <br />structural evaluation for the preliminary engineering report necessary to evaluate the <br />spillway at Lake Kilby Dam. <br />3. That a dollar -for -dollar local match is required as a condition of the <br />funding, which match has previously been appropriated in the FY 2026 Capital <br />Improvement Fund Budget. <br />4. That the State Aid revenue source in the Dam Upgrades Project in the <br />Water Category of the FY 2026 Capital Improvement Fund Budget is increased by <br />$334,117.76 and the Bond revenue source in the Dam Upgrades Project in the Water <br />Category of the FY 2026 Capital Improvement Fund Budget is decreased by <br />$334,117.76. <br />5. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on November 25, 2025. <br />Teste: <br />City Clerk <br />
