(ii) Each parcel so subdivided must front on an existing, improved public street and <br />the proposed subdivision of such parcel shall not require the extension of an <br />existing public street or the construction of a new public street. <br />(iii) The exemption provided by this subsection shall be applied only one time to any <br />qualified parcel of land. Any additional resubdivision of such parcels, or any part <br />thereof, shall not be entitled to such exemption. <br />Sec. 33.1-28. Resubdivision with no new improvements; procedure. <br />(a) The city council has determined that due to the configuration of nonconforming lots and <br />structures on certain parcels of land intended and zoned for residential uses but which were <br />subdivided prior to the enactment of land subdivision ordinances by the City of Portsmouth <br />or Norfolk County, that property owners may be unable to develop such areas which in turn <br />hinders overall redevelopment in Portsmouth. <br />(b) Therefore, the agent is hereby authorized to approve resubdivision plats covering such <br />property even though the requirements of article III of this chapter pertaining to installation <br />of curbs and gutters, street and pavement widening and off-site drainage have not been <br />included. <br />(c) An applicant for resubdivision under this section shall prepare and submit a resubdivision <br />plat as provided in this chapter and shall include a request for approval, stating that the <br />resubdivision meets the requirements of this chapter for resubdivision of exempted <br />property. A request made under this section shall in all other respects be submitted, <br />processed, reviewed and approved in accordance with this chapter. <br />Sec. 33.1-29. Procedure for preliminary plan review for major subdivisions. <br />(a) The subdivider shall submit to the agent two (2) physical copies and one (1) digital PDF <br />copy of the preliminary subdivision plan for a major subdivision and pay the appropriate <br />subdivision plan review fee. The date that any application for approval of a subdivision <br />plan is deemed complete shall constitute the official submission date of the plan on which <br />the statutory period required for formal approval, conditional approval or disapproval of the <br />preliminary or final subdivision plan shall commence to run. <br />(b) When all submittal requirements have been met and the application is deemed complete, the <br />plan shall be reviewed by the agent and other agencies of the city and state as deemed <br />necessary by the agent. The application shall be processed within the time period specified <br />in Code of Virginia, §§ 15.2-2259 and 15.2-2260, as said provisions may be amended from <br />time to time. The agent shall cause the applicant to be notified of approval or denial of the <br />application in writing. If denied, the agent shall state in the notation to the subdivider the <br />specific reasons for denial. The reasons for denial shall identify deficiencies in the plan <br />which cause the disapproval by reference to specific duly adopted ordinances, regulations or <br />policies, and shall generally identify such modifications or corrections as will permit <br />approval of the plan. <br />
