ORDINANCE NO. 2025-78 <br />AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PROPERTY LOCATED <br />IN THE 800 BLOCK OF LAKE KILBY ROAD TO THE CITY OF SUFFOLK FOR A <br />PRICE OF $93,400 AND APPROPRIATING THE PURCHASE PRICE TO THE FY 2026 <br />PUBLIC UTILITIES FUND BUDGET. <br />WHEREAS, the City of Portsmouth currently owns an approximately 2.95 acre parcel <br />located in the 800 Block of Lake Kilby Road in Suffolk and having a Tax Map Number of 24*40 <br />(the "Property"); and <br />WHEREAS, the Property and its surrounding area is shown on Exhibit A hereto; and <br />WHEREAS, City of Suffolk has requested that the City of Portsmouth convey the <br />Property for use in connection with the construction of a new fire station; and <br />WHEREAS, the City of Suffolk has offered to pay the sum of $93,400 to purchase the <br />Property; and <br />WHEREAS, the conveyance of the Property to Suffolk and the development of a fire <br />station thereon will not have a material impact on the watershed protecting Portsmouth's lakes; <br />NOW THEREFORE BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that: <br />1. It approves and authorizes the conveyance of the Property to the City of Suffolk <br />for the sum of $93,400; <br />2. It appropriates $93,400 to the FY 2026 Public Utilities Fund Budget for use by <br />the Department of Public Utilities; <br />3. Estimated revenues and expenditures in the FY 2026 Public Utilities Fund are <br />increased by $93,400; <br />4. The Deed or related recorded documents shall contain a condition that, if the City <br />of Suffolk decides not to build a Fire Station on the Property, the City of Portsmouth shall have a <br />right of first refusal to repurchase the Property for $93,400; <br />5. The Deed or related recorded documents shall also contain a condition that, if the <br />City of Suffolk builds a Fire Station on the Property and at any point in the future decides to use <br />the Property for any purpose other than a Fire Station, the City of Portsmouth shall have a right <br />of first refusal to repurchase Property for $93,400; <br />6. The City Manager is authorized to execute and deliver such deeds, documents, or <br />instruments as may be necessary or desirable in furtherance of the intent of this Ordinance; and <br />7. This ordinance shall take effect as of the date of adoption. <br />
