ORDINANCE NO. 2025-72 <br />AN ORDINANCE ACCEPTING SETTLEMENT FUNDS IN THE AMOUNT OF <br />$150,714.13 FROM THE PFAS SETTLEMENT WITH THE 3M COMPANY AND <br />APPROPRIATING SAID AMOUNT IN THE FY 2026 PUBLIC UTILITIES FUND <br />FOR USE BY THE DEPARTMENT OF PUBLIC UTILITIES FOR WATER <br />SUPPLY TESTING AND TREATMENT AND OTHER AUTHORIZED USES <br />UNDER THE TERMS OF THE SETTLEMENT. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That it hereby accepts settlement funds in the amount of $150,714.13 from <br />the PFAS settlement with the 3M Company and appropriates said amount in the FY 2026 <br />Public Utilities Fund. <br />2. That the appropriation shall be used by the Department of Public Utilities <br />for water supply testing and treatment and other authorized uses under the terms of the <br />settlement. <br />3. That, to the extent not expended, the funds shall be deemed reappropriated <br />into the Public Utilities Fund budget annually until expended in their entirety. <br />4. That no local match is required as a condition of the funding. <br />5. That estimated revenues and expenditures in the FY 2026 Public Utilities <br />Fund Budget are increased by $150,714.13. <br />6. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on September 9, 2025. <br />Teste: <br />City Clerk <br />
