PARCEL 1: THAT certain lot, piece or parcel of land which was <br />conveyed by Houpas Enterprises, Inc. to Maury Wise Cook by deed <br />dated April 16, 1982, and recorded in the Clerk's Office of the Circuit <br />Court of the City of Portsmouth, Virginia, in Deed Book 829, at page <br />337. And more particularly described therein as Lot 1, together with <br />an easement as therein described. <br />PARCEL 2: THAT certain lot, piece or parcel of land which was <br />conveyed by Houpas Enterprises, Inc. to Elliot Cohen by deed dated <br />March 29, 1982, and recorded in the Clerk's Office of the Circuit <br />Court of the City of Portsmouth, Virginia in Deed Book 826, at page <br />685, and more particularly described therein as Lot 2 together with an <br />easement as therein described. <br />PARCEL 3: THAT certain parcel of land having an address of 6063 <br />High Street West and a City Tax Parcel number of 0816-0012. <br />IT BEING a portion of Parcel Two of that certain property conveyed <br />to City Line, LLC by Deed of Gift from Elliot Cohen dated July 20, <br />2010 and recorded in the Clerk's Office of the Circuit Court for the <br />City of Portsmouth, Virginia as Instrument Number 100007029. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The owner and the operator of event space/banquet hall shall ensure and <br />maintain compliance with the following use -specific standards, including <br />as set forth in subsection 40.2-217(G)(5)(c) of the Zoning Ordinance: <br />(i) The event space/banquet hall shall not create unreasonable <br />environmental aspects such as noise, odor, smoke, vibration, heat, <br />or glare. <br />(ii) Noise from the event spacelbanquet hall shall comply with City <br />Code Sec. 24-255 Unlawful Excessive Sound. <br />(iii) Any building housing live entertainment shall include soundproof <br />entryway and exit doors. <br />(iv) Live entertainment shall only permitted indoors. <br />(v) INTENTIONALLY OMITTED. <br />(vi) Before initially operating the event spacelbanquet hall use and so <br />long as the use remains in operation, the owners and/or operators <br />of the establishment shall install and maintain digital video <br />
