7. That the City Manager is hereby authorized and directed to do all things necessary to <br />implement this ordinance and the operating budget approved herein. <br />8. That the payment and settlement during FY 2025 of any claim of any kind against the <br />City (inclusive of fees as applicable), the payment during FY 2025 of any final judgment (including <br />interest and costs) obtained against the City, and/or the payment during FY 2025 of costs, expenses or <br />fees incurred in the defense or evaluation of claims involving the City (whether asserted or unasserted), <br />shall be made upon the certification of the City Attorney and the order of the City Manager from funds <br />appropriated to the Risk Management Fund or from funds appropriated for the expenditures of the Fund <br />involved in the subject matter of the claim or judgment, as the City Manager shall find necessary. <br />9. That the funds appropriated to the line item "Contingency — Other Operating" of the <br />Non -departmental category of the General Fund Budget constitute the City Manager emergency <br />contingency fund, established pursuant to Section 12-5(b) of the City Code. In accordance with the <br />requirements of Section 12-5(b), the City Manager may transfer any or all of the unencumbered portion <br />of the City Manager emergency contingency fund to any item of expense contained in the City budget <br />(including the Capital Improvement Fund budget), reporting such action and reason therefor to City <br />Council at its next regular meeting. <br />10.
