location of the vessel and how it can be retrieved by the owner, in the manner set forth <br />in subsection (c). <br />Sec. 6-7. City piers, wharves, docks, landings, etc.; regulation. <br />(a) Definitions. <br />(1) High Street Inlet means that body of water located at the eastern end of High <br />Street. <br />(2) North Harbor means that body of water adjacent to the Elizabeth River and <br />bordered by Harbor Court, Bill Deal Street, and the Renaissance Hotel. <br />(3) Portsmouth Seawall means that publicly -owned wall and walkway beginning at <br />the northeast corner of the South Inlet and the Southern Branch of the Elizabeth <br />River and running north to the end of the structure approximately 2,880 feet <br />along the west side of the Southern Branch of the Elizabeth River. <br />(b) The following rules and regulations are established for vessels in the North Harbor <br />and the High Street Inlet and along the Portsmouth Seawall: <br />(1) No boater less than 18 years of age shall moor a vessel in the North Harbor or <br />the High Street Inlet. <br />(2) The mooring of recreational vessels in the Elizabeth River along the Portsmouth <br />Seawall is prohibited. <br />(3) Vessels shall tie up or moor only to the docks, not to other vessels. "Rafting up" <br />is not permitted. <br />(4) The anchoring of vessels is not permitted in the North Harbor or the High Street <br />Inlet unless the vessel is also tied up to the dock. <br />(5) Except for ferry vessels being utilized for the operation of the HRT public ferry <br />service, no vessel shall be tied up or moored in the North Harbor or the High <br />Street Inlet for more than 36 continuous hours or a total of 72 hours within any <br />30 -day period. <br />(6) Except for ferry vessels being utilized for the operation of the HRT public ferry <br />service, the mooring of vessels shall be on a first come, first serve basis, and no <br />spaces shall be "held" or reserved for vessels not actually present. <br />(7) Except for ferry vessels being utilized for the operation of the HRT public ferry <br />service, moored vessels shall not exceed 40 feet in length. The portion of the <br />High Street Inlet adjacent to the flagpole shall be utilized only by vessels 35-40 <br />feet in length. <br />(8) The discharge or pumping out of sanitary facilities into the North Harbor or the <br />High Street Inlet is strictly prohibited. <br />(c) The city manager or his/her designee shall establish such additional rules and <br />regulations as he or she shall deem necessary for the safe, sanitary, orderly, and <br />efficient operation of city -owned or city -operated piers, wharves, docks, landings, and <br />other similar water -related or water -dependent facilities. <br />
