ORDINANCE NO. 2024-14 <br />AN ORDINANCE AUTHORIZING PAYMENT OF ESCHEATED FUNDS FROM THE <br />TAX SALE OF 602 WAKEFIELD DRIVE TO JACQUELINE S. WILLIAMS AS <br />AUTHORIZED BY SECTION 58.1-3967 OF THE VIRGINIA CODE AND <br />APPROPRIATING THE SUM OF $21,208.05 FROM THE FUND BALANCE OF THE <br />GENERAL FUND TO THE FY 2024 GENERAL FUND BUDGET FOR SAID <br />PURPOSE. <br />WHEREAS, the property located at 602 Wakefield Drive, Portsmouth, Virginia (the <br />"Property"), was sold at a tax sale and, pursuant to Section 58.1-3967 of the Virginia Code, the <br />surplus funds of that tax sale escheated to the city; and <br />WHEREAS, Section 58.1-3967 of the Virginia Code provides that, after a city receives <br />escheated funds from a tax sale, the former owner or their heirs and assigns may petition City <br />Council to recover the escheated funds, and Council may, in its sole discretion, grant or deny the <br />petition; and <br />WHEREAS, Jacqueline S. Williams has, pursuant to Section 58.1-3967 of the Virginia <br />Code, written a letter to the city, requesting Council pay her the escheated funds from the sale of <br />the Property; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br />1. That it grants relief by authorizing the payment of $21,208.05 to Jacqueline S. <br />Williams, based on her interest in the Property. <br />2. That the sum of $21,208.05 is appropriated from the Fund Balance of the General <br />Fund to the FY 2024 General Fund Budget for said purpose. <br />3. That estimated revenues and expenditures in the FY 2024 General Fund Budget <br />are increased by $21,208.05 <br />4. That this ordinance shall take effect immediately upon adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />February 13, 2024. <br />Teste: <br />City Clerk <br />
