ORDINANCE NO. 2024-13 <br />AN ORDINANCE AUTHORIZING THE REIMBURSEMENT OF CERTAIN LEGAL <br />FEES AND EXPENSES FOR OFFICER VINCENT MCCLEAN PURSUANT TO <br />SECTION 15.2-1711 OF THE VIRGINIA CODE. <br />WHEREAS, retired Officer Vincent McClean was charged with Voluntary <br />Manslaughter in connection with a shooting that occurred on Navajo Trail in May 2018 in <br />the discharge of Officer McClean's official duties (the "Charge"); and <br />WHEREAS, the jury found Officer McClean Not Guilty of the Charge; and <br />WHEREAS, Section 15.2-1711 of the Virginia Code provides that, if a law-enforcement <br />officer is prosecuted on a criminal charge arising out of an act committed in the discharge of his <br />official duties and upon trial is found not guilty, the governing body of the locality may reimburse <br />such officer for reasonable legal fees and expenses incurred by him in defense of the charge; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br />1. That it approves and authorizes the reimbursement of Officer Vincent McClean <br />for legal fees and expenses incurred by him in defense of the Charge that have not been <br />previously reimbursed or paid by a source other than Officer McClean. <br />2. That the reimbursement shall be in the amount of invoiced legal fees and expenses <br />that satisfy the requirements in Section 1 and are deemed reasonable by the City Attorney upon <br />review of the applicable invoices, not to exceed a total of $165,000. <br />3. That the reimbursement shall be paid from funds previously appropriated to the <br />FY 2024 Risk Management Fund Budget. <br />4. That this ordinance shall take effect immediately upon adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />January 23, 2024. <br />Teste: <br />City Clerk <br />
