building at 309 Columbia Street (Tax Parcel 0007-1040), the said property being more <br />particularly described as: <br />UP -23-23 <br />309 Columbia Street <br />(Tax Parcel 0007-1040) <br />ALL THAT certain tract, piece or parcel of land, situate in the City of <br />Portsmouth, State of Virginia, with the appurtenances thereunto <br />belonging, more particularly bounded and described as follows, to -wit: <br />BEGINNING at a pin in the Southeastern corner of the intersection of <br />Court and Columbia Streets; thence along the Southern right-of-way <br />line of Columbia Street, North 87° 14' 28" East 110.0 feet to a pin; <br />thence along the line of Parcel 17, South 3° 27' 52" East 115.72 feet to <br />a pin; thence continuing along said parcel, South 46° 23' 37" East 25.0 <br />feet to a pin; thence along the periphery of a right-of-way cul-de-sac of <br />50 feet radius in a Southwesterly direction for an arc distance of 61.01 <br />feet to a pin; thence along the line of Parcel 23, South 87° 14' 28" <br />West 115 feet to a pin; thence along the Eastern right-of-way line of <br />Court Street, North 3° 27' 52 West 190 feet to the pin at the point of <br />beginning. <br />The hereinabove described parcel is bounded on the North by <br />Columbia Street, on the East by Parcel 17 and a right-of-way cul-de- <br />sac, on the South by Parcel 23, and on the West by Court Street; <br />contains 21,319 square feet, more or less; and is shown on a plat <br />entitled `Physical Survey of Parcel 16 — Portsmouth Redevelopment <br />and Housing Authority — Urban Renewal — Crawford Renewal Project <br />VA R-53 — City of Portsmouth, Virginia', dated March 21, 1971, <br />prepared by R. Kenneth Weeks, Engineers, Norfolk, Virginia. <br />IT BEING the same property conveyed to Printcraft Press, Inc. by <br />Deed of Gift from Drew F. Dixon and Carol Dixon dated May 7, 1996 <br />and recorded in the Portsmouth Circuit Court Clerk's Office in Deed <br />Book 1184 at Page 795. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The child day center shall comply with the use -specific standards set forth <br />in Section 40.2-217(E)(1) of the Zoning Ordinance. <br />(b) Where required by the Zoning Ordinance, all external site and building <br />improvements, including the proposed playground fencing, and any <br />signage, must be approved through issuance of a Certificate of <br />
