(6) Conservation, repletion and research activities of the Virginia Marine Resources <br />Commission, the Virginia Institute of Marine Science, the Department of <br />Wildlife Resources and other <br />conservation - related agencies; <br />(67) The construction or maintenance of aids to navigation that are authorized <br />by governmental authority; <br />(48) Emergency measures decreed by any duly appointed health officer of <br />a governmental subdivision acting to protect the public <br />health; <br />(94) The normal maintenance and repair of, Fepa4 or addition to , presently existing <br />roads, highways, railroad beds, or 04o facilities , <br />abutting on or crossing wetlands, <br />provided that no waterway is altered and no additional wetlands are covered; <br />(910) Governmental activity on in wetlands owned or leased by the commonwealth; <br />or a political subdivision thereof; <br />(4=011) The normal maintenance of manmade drainage ditches, provided that no <br />additional wetlands are covered; and provided further, that this <br />section does not authorize the construction of any drainage <br />ditch= ;_and <br />12) The construction of living shoreline projects authorized pursuant to a general <br />permit developed under subsection B of Code of Virginia § 28.2- 104.1. <br />Sec. 39 -25. Wetlands application fees. <br />A nonrefundable fee as set forth in appendix A to this Code for single - family <br />dwellings and a fee as set forth in appendix A to this Code for all other uses shall be paid <br />to the city treasurer for a permit for the use or development of any wetland within the city <br />under the provisions of this chapter. A receipt showing such payment shall accompany <br />each application for the same. The fee has been set by the city council with due regard for <br />the services to be rendered, including the time, skill and administrator's expense involved. <br />DIVISION 2. WETLANDS BOARD <br />Sec. 39 -46. Created. <br />There is hereby created a wetlands board for the city. In fulfilling its responsibilities <br />under this ordinance, the board shall preserve and prevent the despoliation and <br />destruction of wetlands within its jurisdiction while accommodating necessary economic <br />development in a manner consistent with wetlands preservation and any standards set by <br />the commonwealth in addition to those identified in Code of Virginia L28.2-1308 to <br />ensure protection of shorelines and sensitive coastal habitats from sea level rise and <br />coastal hazards, including the provisions of guidelines and minimum standards <br />promulgated by the commission pursuant to Code of Virginia § 28.2 -1301. <br />39 -47. Composition; appointment of members. <br />
