ORDINANCE NO. 2023-81 <br />AN ORDINANCE TO AMEND AND REORDAIN ARTICLE I OF CHAPTER 32 <br />(STREETS, SIDEWALKS AND LOCAL IMPROVEMENTS) OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA BY ADDING A NEW SECTION 32- <br />31 REGARDING VISIBILITY CLEARANCE AT INTERSECTIONS. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Article I (In General) of Chapter 32 (Streets, Sidewalks and Local <br />Improvements) of the Code of the City of Portsmouth, Virginia is amended and <br />reordained by adding a new Section 32 -31 as follows: <br />Sec. 32 -31. Visibility clearance at intersections. <br />For protection against traffic hazards, no material impediment to <br />visibility shall be placed, allowed to grow, erected or maintained on any <br />parcel so as to restrict sight distance at any intersection of any public <br />street, private road or driveway, or at the intersection of any alley and <br />public street or private road, below the minimum required by Virginia <br />Department of Transportation standards for a similarly situated <br />intersection. In historic or downtown zoning districts, the city engineer <br />may waive these standards to fulfill the purposes and objectives of said <br />districts declared in the zoning ordinance. <br />2. That this ordinance shall take effect on the date of adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on September 26, 2023. <br />Teste: <br />City Clerk <br />
