ORDINANCE NO. 2023 -80 AN ORDINANCE ACCEPTING SETTLEMENT FUNDS IN THE AMOUNT OF $829778.38 FROM THE NATIONAL OPIOIDS SETTLEMENT FUND TRUST AND APPROPRIATING SAID AMOUNT IN THE FY 2024 BEHAVIORAL HEALTHCARE SERVICE FUND FOR USE BY BHS FOR APPROVED ABATEMENT PURPOSES AS DEFINED BY THE VIRGINIA OPIOID FUND AND SETTLEMENT ALLOCATION MOU. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: L That it hereby accepts settlement funds in the amount of $82,778.38 from the National Opioids Settlement Fund Trust and appropriates said amount in the FY 2024 Behavioral Healthcare Service Fund. 2. That the appropriation shall be used by the Department of Behavioral Healthcare Services for "Approved Abatement Purposes ", as defined in Section A and illustrated in Section (C)(4)(a) through 0) of the Virginia Opioid Abatement Fund and Settlement Allocation Memorandum of Understanding approved by City Council Resolution R -21 -24 adopted on August 10, 2021, as amended from time to time. "Approved Abatement Purposes" are generally defined in the MOU as "efforts to treat, prevent, or reduce opioid use disorder or the misuse of opioids or to otherwise abate or remediate the opioid epidemic ". 3. That, to the extent not expended, all opioids settlement funds, including the funds appropriated by this ordinance and the funds appropriated by Ordinances 2022- 80, 2022 -93, 2022 -98. 2023 -09, and 2023 -19, shall be deemed reappropriated into the Behavioral Healthcare Service Fund budget annually until expended by the City. 4. That no local match is required as a condition of the funding. 5. That estimated revenues and expenditures in the FY 2024 Behavioral Healthcare Service Fund Budget are increased by $82,778.38. 6. That this ordinance shall take effect on the date of its adoption. ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on September 12, 2023. Teste: City Clerk
