ALL THAT certain lot, piece or parcel of land, together with all improvements thereon and all appurtenances relating thereto, located in the City of Portsmouth, Virginia, and being designated as "PARCEL N ", on the survey entitled, "BOUNDARY SURVEY OF PROPERTY OF CLARIANT CORPORATION ", dated 01 -06- 98, prepared by engineering services, inc. consisting of three (3) sheets and recorded in the Clerk's Office of the Portsmouth Circuit Court in Map Book 17, at pages 74, 75 and 76. LESS AND EXCEPT that portion of such property which is designated as "PARCEL B -1 " on the plat entitled, "SUBDIVISION PLAT OF THE PROPERTY OF CLARIANT CORPORATION, PORTSMOUTH, VIRGINIA ", dated December 2, 1998, (and signed and sealed on December 4, 1998), prepared by engineering services, inc. and recorded in the Clerk's Office of the Portsmouth Circuit Court in Map Book 17, at pages 182 and 183. AND LESS AND EXCEPT Lots 306, 308 and 310 shown as part of "PARCEL N" on the survey entitled, "BOUNDARY SURVEY OF PROPERTY OF CLARIANT CORPORATION ", dated 01 -06- 98, prepared by engineering services, inc. consisting of three (3) sheets and recorded in the Clerk's Office of the Portsmouth Circuit Court in Map Book 17, at pages 74, 75 and 76. IT BEING all that certain property conveyed to Roger E. Woodington and Glenda B. Woodington, or their successor trustees, Trustees of the Roger E. Woodington Trust dated January 26, 2007, as amended, and Glenda B. Woodington and Roger E. Woodington or their successor trustees, Trustees of the Glenda B. Woodington Trust dated January 26, 2007, as amended, as tenants in common, by Deed from Land and Marine Remediation, Inc. dated January 4, 2010 and recorded in the Portsmouth Circuit Court Clerk's Office as Instrument Number 1000005 18. 6. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The approved use shall be operated in compliance with the Shipping Container /Chassis Storage Yard Use - Specific Standards set forth in Section 40.2- 217(H)(3)(b) of the Zoning Ordinance except to the extent expressly contradicted by another condition in this Section 6. (b) No more than three (3) shipping containers shall be stacked on top of one another.
