ALL THAT certain lot, piece or parcel of land, together with all <br />improvements thereon and all appurtenances relating thereto, <br />located in the City of Portsmouth, Virginia, and being designated <br />as "PARCEL N ", on the survey entitled, "BOUNDARY SURVEY <br />OF PROPERTY OF CLARIANT CORPORATION ", dated 01 -06- <br />98, prepared by engineering services, inc. consisting of three (3) <br />sheets and recorded in the Clerk's Office of the Portsmouth Circuit <br />Court in Map Book 17, at pages 74, 75 and 76. <br />LESS AND EXCEPT that portion of such property which is <br />designated as "PARCEL B -1 " on the plat entitled, <br />"SUBDIVISION PLAT OF THE PROPERTY OF CLARIANT <br />CORPORATION, PORTSMOUTH, VIRGINIA ", dated December <br />2, 1998, (and signed and sealed on December 4, 1998), prepared <br />by engineering services, inc. and recorded in the Clerk's Office of <br />the Portsmouth Circuit Court in Map Book 17, at pages 182 and <br />183. <br />AND LESS AND EXCEPT Lots 306, 308 and 310 shown as part <br />of "PARCEL N" on the survey entitled, "BOUNDARY SURVEY <br />OF PROPERTY OF CLARIANT CORPORATION ", dated 01 -06- <br />98, prepared by engineering services, inc. consisting of three (3) <br />sheets and recorded in the Clerk's Office of the Portsmouth Circuit <br />Court in Map Book 17, at pages 74, 75 and 76. <br />IT BEING all that certain property conveyed to Roger E. <br />Woodington and Glenda B. Woodington, or their successor <br />trustees, Trustees of the Roger E. Woodington Trust dated January <br />26, 2007, as amended, and Glenda B. Woodington and Roger E. <br />Woodington or their successor trustees, Trustees of the Glenda B. <br />Woodington Trust dated January 26, 2007, as amended, as tenants <br />in common, by Deed from Land and Marine Remediation, Inc. <br />dated January 4, 2010 and recorded in the Portsmouth Circuit <br />Court Clerk's Office as Instrument Number 1000005 18. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The approved use shall be operated in compliance with the Shipping <br />Container /Chassis Storage Yard Use - Specific Standards set forth in <br />Section 40.2- 217(H)(3)(b) of the Zoning Ordinance except to the extent <br />expressly contradicted by another condition in this Section 6. <br />(b) No more than three (3) shipping containers shall be stacked on top of one <br />another. <br />
