(c) The development shall in substantial compliance, including without <br />limitation with respect to building design and construction materials, with <br />the rendering and concept exterior elevations titled "Crosscreek <br />Apartments Building 1, 2, and 3 — Exterior Elevations" prepared by TS3 <br />Architects PC dated January 21, 2021, and "Ansell Garden Apts. Building <br />2 — Exterior Elevations" prepared by TS3 Architects PC dated January 27, <br />2023 (each of which are on file with the Planning Department), except <br />where modifications may be required to comply with applicable local, <br />state, or federal codes or regulations. <br />(d) The existing vegetation located in a 10 -foot wide strip along the southern <br />property line abutting existing single - family residences shall be retained to <br />the maximum extent possible. <br />(e) The development shall have not more than 39 multifamily dwelling units. <br />(f) Prior to issuance of Site Plan approval, a Minor Subdivision Plat to vacate <br />the lot lines between 2216 Waldron Avenue and 2220 Waldron Avenue <br />and combine them into a single parcel must be approved by the City and <br />recorded by the property owner. The Plat shall comply with all applicable <br />requirements in Chapter 33.1 (Subdivisions) of the City Code. <br />(g) A Zoning Permit must be obtained from the City Zoning Administrator <br />prior to commencing the use, and a Certificate of Occupancy must be <br />obtained from the City Department of Permits and Inspections prior to the <br />occupancy of a dwelling unit. <br />(h) Prior to occupying any dwelling and for so long as the multifamily <br />dwelling use continues on the property, the owners and/or operators shall <br />install and maintain digital video equipment with recording capabilities <br />sufficient to indicate the date and time that the recording is made. The <br />recording shall provide surveillance coverage encompassing the front, <br />side, and rear exteriors of the development and buildings for 24 hours a <br />day, 7 days a week. Recorded data must be maintained in a condition <br />permitting review of the information for a period of no less than thirty <br />days. <br />(i) All taxes /fees associated with the property and/or the proposed use must <br />be paid when due, as determined by the City Treasurer. <br />(j) Without limitation, this Use Permit is subject to Section 40.2- 533(K) of <br />the Zoning Ordinance, which provides that this Use Permit may <br />automatically expire and become void if certain conditions set forth <br />therein are not satisfied within two (2) years from the date of approval by <br />City Council. <br />
