5. That Community Housing Partners Corporation is hereby granted a use <br />permit pursuant to Section 40.2 -533 of the Code of the City of Portsmouth, Virginia to <br />construct and operate a two - building multifamily dwelling development having not to <br />exceed 39 total units at 2216 Waldron Avenue and 2220 Waldron Avenue (Tax Parcels <br />0465 -0380 and 0465- 0390), being more particularly described as: <br />UP -22 -22 <br />2216 Waldron Avenue <br />(Tax Parcel 0465 -0390) <br />2220 Waldron Avenue <br />(Tax Parcel 0465 -0380) <br />ALL THOSE certain pieces, parcels, sections or lots of land, together <br />with the easements and appurtenances belonging thereto, situate in the <br />City of Portsmouth, Virginia, and being known, numbered and <br />designated as the Eastern 180.00 feet of Lot (Section) 2 and all of Lots <br />(Sections) 3, 4, 5, 6 and 7, in Block K, as shown on the map entitled <br />"Plat of Garden Homes ", recorded in the Clerk's Office of the Circuit <br />Court of the City of Chesapeake, Virginia, in Map Book 21, at Pages <br />68 and 69, the Southwest corner of such property being a point on the <br />North side of Waldron Avenue 60.00 feet East of Third Street (now <br />called Raven Street) together with all the right, title and interest <br />appertaining thereto in and to the platted lane designated as Waldron <br />Avenue on the aforesaid plat, adjacent to and south of the said <br />property. <br />IT BEING Parcel Two of that certain property conveyed by Deed of <br />Assumption between Greenbrier Woods Corporation and Portsmouth - <br />Afton Square, LP dated November 7, 2002 and recorded in the <br />Portsmouth Circuit Court Clerk's Office as Instrument Number <br />020035943. <br />6. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) Without limitation, the development shall be and remain in compliance <br />with the use - specific standards set forth in Section 40.2- 217(D)(1)(d) <br />(Dwelling, Multi- Family) of the Portsmouth Zoning Ordinance. <br />(b) The development shall be in substantial compliance with the conceptual <br />site plan entitled "Waldron Avenue — Portsmouth, VA" prepared by <br />Timmons Group, dated January 23, 2023, and on file with the Planning <br />Department, except where modifications may be required to comply with <br />applicable local, state, or federal codes or regulations. <br />
