R -23 -41 <br />A RESOLUTION AUTHORIZING THE CONVEYANCE OF TWO DRAINAGE <br />EASEMENTS ENCUMBERING PROPERTY HAVING A SUFFOLK TAX PARCEL <br />NUMBER OF #35 *XX TO THE COMMONWEALTH OF VIRGINIA IN <br />FURTHERANCE OF THE CONSTRUCTION OF THE SPSA FLYOVER RAMP <br />ALONG ROUTE 58. <br />WHEREAS, the Virginia Department of Transportation intends to construct a flyover <br />ramp to allow access to the SPSA landfill facility from the eastbound lanes of Route 58; and <br />WHEREAS, currently accessing the SPSA facility from the eastbound lanes requires <br />cutting across the westbound lanes, which creates a traffic hazard; and <br />WHEREAS, the City owns an abandoned railroad right of way in Suffolk identified as <br />Tax Parcel #35 *XX; and <br />WHEREAS, in furtherance of the flyover project, VDOT has requested that the City <br />grant two drainage easements encumbering the City's property; and <br />WHEREAS, one easement is approximately 42 feet by 120 feet and the second easement <br />is approximately 30 feet (variable width) by 1,080 feet; and <br />WHEREAS, the Departments of Public Utilities and Engineering have reviewed the <br />proposed easements and determined that they will have no negative impact on the City's water <br />facilities; and <br />WHEREAS, the flyover will improve traffic flow on Route 58, eliminate a significant <br />traffic hazard, and benefit SPSA (of which the City is a member); <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it hereby approves and authorizes the conveyance of the requested easements to the <br />Commonwealth of Virginia, and that the City Manager is hereby authorized to execute such <br />documents or instruments as may be necessary or desirable in furtherance of the intent of this <br />Resolution. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />September 26, 2023. <br />Teste: <br />City Clerk <br />
