202 -65 <br />a 7 �4 <br />ZONING AMENDMENT ORDINANCE Z -22 -03 <br />WHEREAS, The Alliance Church ( "Owner ") owns a certain parcel of property <br />located in Portsmouth and having an address of 5809 Portsmouth Boulevard and a Tax <br />Parcel designation of 0616 -0140 (the "Property "); and <br />WHEREAS, a minor subdivision plat (the "Plat ") has been submitted to the City <br />to subdivide the Property into two separate parcels, one an approximately 1.944 acre <br />parcel containing the existing Alliance Church building (the "Church Parcel ") and one an <br />approximately 2.355 acre parcel containing the former Alliance Christian School (the <br />"School Parcel "); and <br />WHEREAS, Owner and Coastal Virginia Management LLC ( "Applicant ") desire <br />to rezone the School Parcel but not the Church Parcel; and <br />WHEREAS, Owner and Applicant have represented that the Plat, in a form <br />approved by the City, will be promptly placed of record after approval of the rezoning <br />application to legally create the Church Parcel and the School Parcel; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia: <br />1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance, which now zones as UR, Urban Residential the area of <br />5809 Portsmouth Boulevard described in Petition for Zoning Amendment Number Z -22- <br />03, is hereby amended and changed so as to show said area zoned as NMU, <br />Neighborhood Mixed Use, and that said area is hereby zoned as NMU, Neighborhood <br />Mixed Use. <br />2. That the property affected by this ordinance by being zoned from UR, <br />Urban Residential to NMU, Neighborhood Mixed Use is furthermore described as <br />follows: <br />Z -22 -03 <br />APPROXIMATELY 2.355 ACRES OF 5809 Portsmouth <br />Boulevard <br />(Portion of Tax Parcel 0616 -0140) <br />THAT CERTAIN portion of 5809 Portsmouth Boulevard (Tax <br />Parcel 0616 -0140) containing approximately 2.355 acres labeled <br />"PARCEL 2" on that certain plat titled "Subdivision of 5809 <br />Portsmouth Boulevard as Shown in Instrument # D 150001170/Tax <br />Parcel # 616 -140 /Owned by the Alliance Church (5809 Portsmouth <br />Boulevard) Portsmouth, Virginia ", prepared by Tim Fallon Land <br />
