AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 19 -1, 25 -92, 20 -20, AND 20 -7 AND APPENDIX A OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) FOR THE PURPOSE OF ESTABLISHING, RESCINDING OR MODIFYING TAXES, RATES AND FEES FOR NON - RESIDENT LIBRARY CARDS, YOUTH AND SENIOR USE OF RECREATIONAL FACILITIES, ITINERANT VENDORS, AND ALCOHOLIC BEVERAGE LICENSES. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Article I of Chapter 19 (Libraries and Museums) of the Code of the City of Portsmouth, Virginia (2006) is amended by deleting Section 19 -1 for the purpose of eliminating the non - resident library card fee. Except as shown below, Chapter 19 is not otherwise amended. Sec. 19 -1. — Reserved. 2. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of eliminating the non - resident library card fee in accordance with Section 1 of this ordinance. 3. That Article III of Chapter 25 (Parks and Recreation) of the Code of the City of Portsmouth, Virginia (2006) is amended by modifying Subsection 25 -92(c) as shown below to facilitate the elimination of certain fees for use of athletic, recreational and special activity facilities by youth and seniors. Except as shown below, Chapter 25 is not otherwise amended. Sec. 25 -92. - Fees for use of athletic, recreational and special activity facilities. (c) For purposes of this subsection (c) and the related fees set out in Appendix A to this Code, the term youth means any person under 18 years of age, the term adult means any person between and including the ages of 18 and 54, and the term senior means any person 55 years or older. Fees for individual use of recreational facilities operated by the department of parks, recreation and leisure services and determined by the city manager to be subject to this mi a- 2.
